RS Constitutional Court: Declaration on the closure of OHR does not violate Bosniak vital national interest

The Constitutional Court of the Republika Srpska (RS) has ruled that the declaration adopted by the National Assembly of RS on closing the Office of the High Representative (OHR) in Bosnia and Herzegovina does not violate the vital national interest of the Bosniak people. The court stated that the declaration expresses a political stance rather than a general legal act, and therefore falls outside its jurisdiction to assess compliance with the constitution.

Veće za zaštitu vitalnog interesa Ustavnog suda Republike Srpske (RS) na današnjoj sednici u Banjaluci ocenilo je da nije povređen vitalni nacionalni interes bošnjačkog naroda usvajanjem Deklaracije o zatvaranju Kancelarije visokog predstavnika (OHR) u BiH, koju je Narodna skupština RS donela 26. maja.

Iz Ustavnog suda RS je saopšteno da je ovakva odluka doneta zbog ocene da "sadržina i forma osporene deklaracije, kao i pitanja koja se njom tretiraju, ne sadrži pravne norme opšteg karaktera niti se na opšti, pravno obavezujući način uređuju neki odnosi".

"Imajući u vidu da se osporenom deklaracijom izražava politički stav Narodne skupštine u pogledu određenih pitanja političke prirode, koja su u vezi s pravima i dužnostima RS i drugim opštim pitanjima od interesa za građane, Veće je ocenilo da osporena deklaracija ni po sadržini ni po formi nema karakter opšteg pravnog akta" istakli su iz Ustavnog suda RS.

Zbog toga je, dodali su, Veće utvrdilo da nije u njegovoj nadležnosti da ocenjuje saglasnost osporene deklaracije s odredbama Ustava, koje štite vitalne nacionalne interese konstitutivnih naroda u RS.

Zajtev Ustavnom sudu RS podneo je Klub Bošnjaka u Veću naroda RS, smatrajući da je usvojenom deklaracijom povređen vitalni nacionalni interes bošnjačkog naroda u RS.
