Vrhovni sud objavio je u četvrtak da je strankama otpremio pravomoćno odluku i rješenje u predmetu kolokvijalno nazvanom konvertirani CHF krediti, prema kojoj korisnici kredita u švicarskim francima, a koji su prihvatili konverziju kredita u euro, nemaju pravo tražiti povrat preplaćenih iznosa.

Kako je pojasnio najviši sud, korisnici kredita nemaju pravo na povrat glavnice preplata iz ništetnih odredbi, ali im se priznaje pravo na zatezne kamate na te preplaćene iznose do dana konverzije i to za razdoblje od sklapanja temeljnog ugovora o kreditu do dana prestanka obveze izvršenom konverzijom, odnosno do 30. rujna 2015. godine.
- Tužitelju pripadaju od dana sklapanja Ugovora o kreditu pa do dana prestanka obveze izvršenom konverzijom kredita zatezne kamate na preplaćene iznose temeljem ništetnih i nepoštenih odredbi o promjenjivoj kamatnoj stopi i deviznoj klauzuli u CHF, što znači na sve one iznose koje je tužitelj plaćao više od početnog tečaja i od početne kamatne stope, stoji u priopćenju Vrhovnog suda.
Najviši sud ističe da tužitelju te zatezne kamate pripadaju u cijelosti i bez oduzimanja od bilo kakve preplate utvrđene aneksom Ugovora o kreditu na temelju Zakona o izmjeni i dopunama Zakona o potrošačkom kreditiranju.
Vrhovni sud je izvijestio kako je odluku donijelo vijeće sastavljeno od sudaca Damira Kontreca kao predsjednika vijeća te Jadranka Juga kao člana vijeća i suca izvjestitelja te Igora Periše, Josipa Turkalja, Marine Paulić, Đure Sesse, Dražena Jakovine, Mirjane Magud, Goranke Barać-Ručević, Ante Perkušića, Renate Šantek, Darka Milkovića i Nere Radas kao članova vijeća.

Udruga Franak poručuje da je razočarana.
- Takva odluka za nas je apsolutno neprihvatljiva. Ona je nezakonita, ona je protivna Ustavu, protivna Konvenciji za ljudska prava. Ona je arbitrarna i ona je diskriminacijska. Diskriminacijska je zbog toga što potrošači koji jesu konvertirali svoje kredite na kraju za ukupnu otplatu kredita plaćaju od 20% do 30% više nego potrošači koji nisu konvertirali svoje kredite, a u potpunosti su obeštećeni. Nažalost, potrošači koji će imati takve presude moći će samo ustavnim tužbama rješavati svoje probleme na Ustavnom sudu, rekao je Goran Aleksić , Udruga Franak.

Prema navodima Udruge Franak, koja je smatra da je potrošačima pripada i povrat glavnice, odluka je donesena glasanjem devet naprema četiri odnosno da su suci Damir Kontrec, Jadranko Jug, Dražen Jakovina i Josip Turkalj dali izdvojena mišljenja kojima pobijaju većinski stav proširenog vijeća najvišeg suda.

Četiri suca dala izdvojena mišljenja
- Zasad ostaje da svaka strana plaća svoj dio troška, ali to nije održivo. Banke će morati platiti najmanje 30 posto našeg troška po Zakonu o parničnom postupku, ali po pravu EU morale bi platiti puni trošak, stoji u objavi Udruge Franak.
Najviši sud je u svojoj odluci priložio izdvojeno mišljenje člana sudskog vijeća Jadranka Juga koji smatra da potrošač, bez obzira na izvršenu konverziju kredita u euro ima pravo potraživati iznose koje je banka stekla bez osnove zbog primjene ništetnih odredbi o promjenjivoj kamatnoj stopi i valutnoj klauzuli u švicarskim francima.
Jug precizira da je riječ o iznosima koji su utvrđeni kao razlika plaćenog u odnosu na ono što je trebalo platiti po početnoj ugovorenoj kamatnoj stopi i početnom ugovorenom tečaju kune u odnosu na CHF (pravo na glavnicu i zatezne kamate), a sve umanjeno za preplatu priznatu i obračunatu u konverziji.
Također, Vrhovni sud je priložio i izdvojena mišljenja sudaca Damira Kontreca i Dražena Jakovine prema kojima je niti jednom odredbom Zakona o izmjeni i dopunama Zakona o potrošačkom kreditiranju, a niti aneksom ugovora o kreditu nije regulirano pitanje pretplata u primjeni ništetnih ugovornih odredaba, posebice ne onih o valutnoj klauzuli.
Suci Kontrec i Jakovina preciziraju kako u vrijeme provođenja konverzije tužitelju nisu bili poznati svi parametri jer ugovorna odredba o valutnoj klauzuli još nije bila utvrđena ništetnom.
Izdvojeno mišljenje dao je i sudac Josip Turkalj koji je istaknuo kako korisnici kredita koji su prihvatili konverziju nisu dovedeni u jednak položaj kao oni korisnici kredita koji nisu prihvatili konverziju.
