The RS Constitutional Court rejected the Bosniak's request for a declaration on OHR

The Constitutional Court of the Republic of Srpska has rejected the request by the Bosniak Delegates' Club regarding the declaration on closing the Office of the High Representative (OHR). The Council for Protection of Vital Interest at the Constitutional Court of the Republic of Srpska determined that the declaration passed by the National Assembly of the Republic of Srpska does not constitute a general legal act and is outside its jurisdiction. Dokument, čije dijelove je objavila Srna, ima tri dijela koji se odnose na status visokog predstavnika kroz Dejtonski mirovni sporazum i njegove anekse, Schmidtov mandat i njegov legitimitet, ali i na budućnost OHR-a.

U prvom dijelu, dokument se referira na OHR kao instituciju, navodeći da je nastala kroz Aneks 10 na Dejtonski sporazum i da je predviđala nadgledanje implementacije civilnog dijela ovog sporazuma.

Dalje se navodi da Bonske ovlasti nisu dio Dejtonskog mirovnog sporazuma, navodeći da su one rezultat odluke Vijeća za provedbu mira (PIC) donesene na Bonskoj konferenciji 1997. godine.

U drugom dijelu, Ustavni sud RS-a kritikuje Ustavni sud Bosne i Hercegovine zbog odluke da ne raspravljaju o nametanjima Schmidta, citirajući međunarodni karakter OHR-a.

"Ustavni sud BiH stao je na stanovište da se ovi zakoni ne trebaju, odnosno ne mogu ispitivati jer se radi o instituciji međunarodnog karaktera, ali se istovremeno, što je, samo po sebi kontradiktorno, ocjenjuje da su to zakoni BiH, tj. visokog predstavnika, koji je u ovom slučaju djelovao kao institucija u BiH, te da se isti mogu ispitivati s materijalnopravnog aspekta zato što regulišu materiju koja je predviđena Ustavom BiH", navodi se u dokumentu Ustavnog suda RS-a.

Dalje se ističe da je Ustavni sud BiH, u svim ovakvim slučajevima, većinskim mišljenjem sudija ocijenio da ovi zakoni nisu protivni Ustavu BiH, čime je odlukama dat legalitet, ali "ne i legitimitet".

"Značajno je istaći da u svim odlukama, odnosno zakonima koje je nametnuo visoki predstavnik postoji norma kojom se propisuje da domaće institucije, u ovom slučaju Parlamentarna skupština BiH, iste mora usvojiti u identičnoj formi i sadržaju, prije negoli usvoji bilo kakvu izmjenu ili dopunu ovih zakona, čime je zakonodavni organ prisiljen da da legalitet i legitimitet ovim aktima", obrazložio je Ustavni sud RS-a.

Naglašavaju da je osim materijalnog karaktera zakona, za njegov legitimitet važno i ko je donio zakon te na koji način.

Dalje su obrazložili da je nametanjem zakona, bez prolaska kroz parlamentarnu proceduru odnosno usvajanje u oba doma Parlamentarne skupštine BiH, prekršen član Ustava BiH kojim se propisuje "zaštita vitalnog nacionalnog interesa" u ovim institucijama kroz entitetsko glasanje.

"Pored ovoga, propisujući obavezu da Parlamentarna skupština BiH navedene zakone mora usvojiti u identičnom obliku i sadržaju, visoki predstavnik direktno je prekršio Ustav BiH i to u pogledu poštovanja ustavnih normi o zakonodavnom postupku, da pri ovome ne govorimo o ograničenju demokratske volje

izabranih narodnih predstavnika", ističe se.

Argumenti koje je Ustavni sud RS-a iznio u Obavještenju su već poznati javnosti s obzirom na to da su ih političari iz RS-a mnogo puta ponovili. oni su također dobili i valjane odgovore na njihove argumente, a tvrdnje im je pobio i Sud BiH prilikom donošenja pravosnažne presude protiv Dodika.

Na kraju Obavještenja, Ustavni sud RS-a poziva da naredni visoki predstavnici ograniče svoje ovlasti i da ih ne koriste na način kako je to radio Schmidt jer smatraju da je on kršio zakone BiH.
