Ústavný súd v stredu 17. júna rozhodol, že vláda musí okamžite požiadať parlament o dôveru, keďže ju k tomu zaväzuje ústavný zákon o rozpočtovej zodpovednosti. Premiér Robert Fico (Smer) vzápätí zareagoval, vláda mimoriadne zasadla ešte v ten istý deň a parlament tak môže dnes o dôvere vláde rokovať a aj hlasovať.

„Vláda SR plne rešpektuje ústavný zákon o rozpočtovej zodpovednosti a uvedomuje si, že má povinnosť požiadať Národnú radu SR o vyslovenie dôvery, pretože došlo k naplneniu jedného z parametrov ústavného zákona o rozpočtovej zodpovednosti,“ povedal Fico po mimoriadnom rokovaní vlády s tým, že vláda pôvodne plánovala požiadať o dôveru pri schvaľovaní rozpočtu na budúci rok. Podľa neho má vláda iný výklad ako Ústavný súd.

Povinnosť požiadať o vyslovenie dôvery vyplýva zo sankčných pásiem takzvanej dlhovej brzdy, ktorá je súčasťou ústavného zákona o rozpočtovej zodpovednosti. Vyžaduje to najprísnejšie, piate sankčné pásmo. Ficova vláda však túto povinnosť ignorovala od 22. novembra minulého roku. Práve vtedy vypršala dvojročná lehota, počas ktorej sa sankcie troch najprísnejších pásiem dlhovej brzdy neuplatňujú. Táto lehota začala plynúť od schválenia programového vyhlásenia vlády.

Dvojročné ochranné obdobie v zákone existuje preto, aby nastupujúca vláda nedoplácala na prípadné nezodpovedné hospodárenie predchádzajúcich vládnych garnitúr. Každý kabinet tak má dva roky na to, aby hrubý dlh dostal pod kontrolu. Po dvoch rokoch má z pohľadu zákona o rozpočtovej zodpovednosti prevziať plnú zodpovednosť za výšku dlhu.

Vyrovnaný rozpočet sa vláda zostavovať nechystá

Fico síce deklaruje, že vláda ústavný zákon o rozpočtovej zodpovednosti rešpektuje, no zároveň dlhodobo spochybňoval, že by sa jej sankcie týkali.

Týka sa to aj ustanovenia, že by vláda mala predložiť vyrovnaný alebo prebytkový rozpočet, čo je sankcia vyplývajúca zo štvrtého sankčného pásma dlhovej brzdy.
