Înalta Curte de Casație și Justiție a stabilit joi că primarul Timișoarei, președinte al USR, este în conflict de interes, în dosarul în care a fost acuzat de Agenția Națională de Integritate. Decizia instanței supreme menține hotărârea inițială a Curții de Apel Timișoara din 10 februarie și este definitivă.
Dominic Fritz este primar al Timișoarei din septembrie 2020, fiind la al doilea mandat. Din poziția de președinte al USR, este unul ditrecei mai puternici susținători ai lui Ilie Bolojan.
În comunicatul de presă prin care anunță decizia de joi, instanța supremă nu face nicio referire la efectele acestei hotărâri.
În decizia Curții de Apel Timișoara, însă menținută azi de ICCJ, magistrații scriu, invocând Codul Administrativ, că un primar în stare de incompatibilitate sau conflict de interese își pierde mandatul: „Mandatul încetează de drept”.
Dominic Fritz a reacționat imediat după decizia ICCJ , spunând că o va ataca la CEDO și că nu-și va pierde mandatul, „așa cum s-a speculat în presă”, ci doar că îi interzice candidatura până în 2030.
Decizia instanței supreme
Înalta Curte afirmă, într-un comunicat de presă, că Dominic Fritz „a participat la emiterea unui act administrativ prin care, folosindu-și autoritatea funcției, a procurat beneficii propriului creditor de la care primise un împrumut pentru finanțarea campaniei electorale pentru alegerile locale de la Primăria Municipiului Timișoara”.
„Situația de fapt în care s-a aflat domnul Fritz corespunde elementelor pe care legislația și jurisprudența le identifică drept relevante în materia conflictului de interese: existența unei relații financiare directe, participarea la emiterea actului și posibilitatea ca interesul personal să afecteze imparțialitatea exercitării funcției publice”, conform comunicatului.
Instanța spune că „dispozițiile legale instituie obligația de abținere atunci când alesul local se află într-o situație de conflict de interese”.
„Această obligație există tocmai pentru a proteja încrederea publică în corectitudinea procesului decizional și pentru a împiedica transformarea autorității publice într-un instrument de favorizare a unor interese private. Același standard trebuie aplicat tuturor, indiferent de funcția ocupată sau de apartenența politică”, mai notează Înalta Curte.
Curtea de Apel Timișoara care a dat prima decizie: Mandatul se pierde automat
În hotărârea Curții de Apel Timișoara din 10 februarie, consultată de HotNews, se precizează că odată cu pierderea definitivă a procesului cu ANI, Fritz își pierde și mandatul de primar.
După decizia instanței de fond, Dominic Fritz explica însă pe Facebook că dacă decizia va rămâne definitivă va fi sancționat cu reducerea indemnizației cu 10% pe o perioadă de maximum 6 luni.
Explicațiile primarului au fost contrazise de judecătorul Curții.
„Pentru aleşii locali (primar, preşedinte al consiliului judeţean, consilier local sau judeţean) în privinţa cărora, printr-un raport de evaluare definitiv, s-a constatat a fi în stare de incompatibilitate sau conflict de interese, legiuitorul a prevăzut că mandatul lor încetează de drept, conform art. 160, 193 şi 204 din Codul administrativ, cu modificările şi completările ulterioare, norme preluate din Legea nr. 215/2001, situaţie juridică ce este constatată prin ordin al prefectului”, se arată în motivarea Curții de Apel Timișoara.
Curtea a invocat „gravitatea atingerii aduse interesului public prin actele de corupție și cele conflictele de interese chiar și din cele mai puțin semnificative” ale aleșilor într-un context național de risc ridicat de corupție.”
Și, din acest motiv, a apreciat că interdicția de a ocupa funcții publice alese pentru o durată prestabilită de 3 ani, prevăzută de legislația națională, nu este disproporționată.
Acuzațiile pe care ANI i le-a adus lui Dominic Fritz
În iulie 2024, Agenția Națională de Integritate l-a declarat pe Dominic Fritz în conflict de interese administrativ.
Inspectorii de integritate au acuzat că în anul 2020, după ce a fost ales primar al Timișoarei, Dominic Fritz a aprobat un referat de modificare a unui Plan Urbanistic Zonal (PUZ), pe care l-a înaintat Consiliului Local spre aprobare. Documentația tehnică pentru beneficiarul acestui PUZ a fost făcută de către firma unui consilier local USR, care l-a împrumutat pe candidatul Dominic Fritz cu 25.000 de lei în respectiva campanie electorală.

În acțiunea depusă în instanță împotriva ANI, primarul Dominic Fritz a explicat că în 2020, după preluarea mandatului de primar, „a preluat din mers şi procedurile administrative demarate de predecesorul acestuia, Nicolae Robu, în vederea emiterii/adoptării anumitor acte administrative considerate oportune pentru comunitatea locală”.
