El juez que investiga a la actriz Elisa Mouliaá por presuntas calumnias al exportavoz de Sumar Íñigo Errejón ha ordenado su detención y que sea puesta a disposición judicial, tras no comparecer el lunes por tercera vez , estando ya advertida de que podría ser arrestada en caso de volver a ausentarse.
En un auto dictado este martes, el juez Arturo Zamarriego recuerda que ha citado en tres ocasiones a la actriz, quien ha demostrado "una clara e inequívoca voluntad de sustraerse a la acción de la Justicia, por lo que procede acordar su detención " y puesta a disposición del juzgado para ser oída en declaración.
"Mi intención no es eludir la Justicia, sino precisamente obtener una tutela judicial efectiva, imparcial y con todas las garantías que reconoce nuestro ordenamiento jurídico y el Convenio Europeo de Derechos Humanos", aseguró Mouliaá a preguntas de EL MUNDO tras anunciar que no comparecería a la citación judicial de esta semana.
"Cuando una persona denuncia unos hechos graves y la causa principal [la presunta agresión sexual por la que acusó a Íñigo Errejón] permanece bloqueada durante meses mientras se intensifica la presión procesal sobre la denunciante en procedimientos accesorios, es lógico plantearse si se están respetando plenamente los derechos fundamentales y las garantías procesales ", aseguró en referencia al proceso paralelo emprendido por la actriz en el que acusa a Íñigo Errejón de agresión sexual.
Una ausencia que, la empresaria y actriz sostenía que se encontraba perfectamente justificada . "Estuve de baja médica durante meses, circunstancia acreditada mediante los correspondientes informes psicológicos y documentación médica aportada al procedimiento. En este momento me encuentro trabajando en virtud de un contrato profesional internacional que me mantiene desplazada en el Mar Rojo, en zonas donde la cobertura es limitada o inexistente ", aseguró.
Ante la posibilidad de ser detenida, manifestó que "precisamente porque las actuaciones que se están produciendo no me parecen normales ni compatibles con las garantías que deben regir un Estado de Derecho , considero imprescindible que sean revisadas por instancias superiores".
Asimismo, insistió en que tanto ella como su abogada, Yurena Carrillo, están "convencidas de que todas las actuaciones realizadas en este procedimiento acabarán siendo revisadas por las instancias competentes. Confío plenamente en que se analizará si se han respetado los derechos fundamentales, las garantías procesales y los estándares europeos de tutela judicial efectiva".
Mouliaá también señaló que " cuando un juez se excede en el ejercicio de su poder, tarde o temprano alguien revisa sus actuaciones . Y entonces llegarán las responsabilidades".
Una batalla judicial en tres frentes
La batalla judicial entre Elisa Mouliaá e Íñigo Errejón comenzó el 25 de octubre de 2024, cuando la actriz denunció al exfundador de Podemos , cofundador de Más Madrid y exdirigente de Sumar por un presunto delito de agresión sexual.
Mientras se instruía ese procedimiento, Íñigo Errejón presentó una querella contra Elisa Mouliaá por un presunto delito de calumnias , al considerar que la actriz le había acusado falsamente de extorsionar o manipular a testigos relacionados con la causa.
La actriz calificó esa acción judicial como una "estrategia de descrédito que proyecta sobre la querellante hechos inexistentes" y, junto a su abogada, respondió con una nueva querella contra el expolítico . Además, aseguró que interpondría una denuncia por "violencia institucional" , al considerar que está sufriendo "un trato desproporcionado, lesivo y profundamente dañino tanto a nivel jurídico como mediático".
