El caso Zapatero dio este miércoles una vuelta de tuerca tras la declaración del expresidente socialista, que no logró cambiar las sospechas del juez sobre los indicios de delito. Según el instructor, esos indicios siguen intactos después de que José Luis Rodríguez Zapatero tuviera la primera oportunidad de aclarar si el relato contenido en el auto de imputación se basaba en meras conjeturas.
El juez José Luis Calama respondió en dos direcciones después de escuchar casi dos horas al exdirigente: por un lado, evitó convertir el acto en un espectáculo, lo que habría ocurrido en caso de imponer medidas cautelares a alguien que tiene imposible fugarse y, por otro, dejó claro que Zapatero no dio una sola explicación razonable que descarte las sospechas previas de que cobró a cambio de mediar en el rescate de Plus Ultra y otras prácticas de tráfico de influencias.
Las tablas perjudican al expresidente. Los informes de la UDEF presentan inferencias de tal magnitud que conducen a la imputación de varios delitos a Zapatero, quien trasladó a través de su entorno que el contenido de los mismos le provocaba indignación. En la Audiencia Nacional tuvo la oportunidad de presentar documentación y ofrecer explicaciones precisas que diluyeran la fe de la Fiscalía Anticorrupción y el juez Calama en las tesis policiales. Pero no lo hizo, según concluye el juez instructor en el auto donde descarta imponerle medidas cautelares y, al tiempo, deja claro que no ha creído sus explicaciones.
Hay dos asuntos capitales de los que Zapatero se marchó de la Audiencia Nacional sin dar explicaciones suficientes, según refieren fuentes de la investigación: qué trabajos hizo que justifiquen el medio millón de euros que le pagó Análisis Relevante –la consultora de su amigo Julio Martínez Martínez– y el papel de sus hijas en la supuesta trama investigada, que cobraron 800.000 euros de empresas vinculadas a sus negocios.
Los dos aspectos resultan clave porque la Audiencia Nacional cree que Zapatero cobraba de Análisis Relevante por unos informes inexistentes que, en ocasiones, se presentaban incluso como “verbales”. De esta forma, él y su pagador, Julio Martínez Martínez, habrían disimulado el verdadero motivo de los desembolsos, la intercesión del expresidente en el rescate de Plus Ultra por medio del tráfico de influencias, así como en otras operaciones de compañías con intereses en obtener ayudas públicas o favores.
Plus Ultra, que opera la línea Madrid-Caracas, tenía contratado a Julio Martínez Martínez como una especie de conseguidor para resolver sus problemas en Venezuela. La aerolínea le pagó de forma directa o indirecta más de 900.000 euros entre 2020 y 2024. En ese mismo período de tiempo, la consultora de este empresario abonó más de 700.000 euros a la familia del expresidente: 490.780 a Zapatero y 239.755 a Whathefav, la agencia de marketing de sus hijas.
Ante el juez, Zapatero defendió que no ejerció ninguna influencia para favorecer que la aerolínea lograra el rescate de 53 millones de euros en plena pandemia. Respecto a los pagos que recibió de Análisis Relevante, dijo que eran a cambio de trabajos de asesoría y que cobraba por ellos a final del año de forma conjunta, si bien no aportó documentación u otro tipo de pruebas que sustentara su relato. También ha entregado un escrito con su “consentimiento expreso” a comprobar que no tiene activos fuera de España.
El segundo aspecto que quedó sin dilucidar y que aboca a una próxima investigación a las hijas de Zapatero –el PP, como acusación popular, ya ha pedido que se las investigue– son precisamente los 239.755 euros que la empresa de ambas recibió de Análisis Relevante. Y también el más de medio millón de euros que su agencia recibió de otra sociedad, Inteligencia Prospectiva, propiedad de dos hermanos venezolanos y que también hizo pagos a Análisis Relevante. Tanto esta última sociedad como Inteligencia Prospectiva son dos empresas fallidas, según la Oficina Antifraude. Nada hacían y nada, por tanto, tenían que subcontratar, sospechan el juez y Anticorrupción.
Las fuentes de la investigación consultadas por elDiario.es trasladan la sensación de que Zapatero llegó a desentenderse durante el interrogatorio de cualquier explicación que tuviera que ver con la facturación de las empresas de sus hijas. Sostienen que el expresidente se habría dedicado, en este tema, a “soltar lastre” y que sean las hermanas quienes ofrezcan explicaciones si son llamadas a declarar.
Las conclusiones provisionales de los investigadores pasan porque Zapatero no realizó servicios reales a la consultora de su amigo y que, por tanto, resulta difícil que pueda explicar la “confusión” entre los pagos por sus supuestos trabajos y los que hacía la agencia de sus hijas, indican las fuentes consultadas por este medio.
