After we reported in Domovina on the lawsuit filed by the owner of the plot on the route of the C0 canal for the excavation of the pipe, two lawsuits were filed last week against another notorious project by the mayor of Ljubljana, Zoran Janković, which is upsetting the public pren renovation of the Ljubljana market.

The administrative unit of Ljubljana issued an integral building permit on 21 April this year, which includes the complete renovation and extension of the Mahrova House, the construction of an underground car park under the open market and the complete renovation of the Vodnikovo Market, as well as the upgrading of the gas and electricity network and the relocation of part of the public water supply network.

In Homeland we obtained the lawsuit filed by the NGO Alpe Adria Green against the Republic of Slovenia, represented by the Ministry of the Environment, on 21 May. They claim that the contested building permit is completely irregular and illegal. Already last year, in a series of articles, we pointed out that the documentation of the Municipality of Ljubljana for obtaining a building permit was prepared on the illegal and obsolete regulations on noise, and although, according to our writing, the Golobov government (the country) reacted at the end of November last year and nevertheless adopted a new one, which is in accordance with European Union law, the building permit was issued on the basis of an illegal regulation, but the procedure was never repeated.

As can be seen from the complaint, attorney Golob, on behalf of Alpe Adria Green, also accuses the Ministry of Natural Resources and Space of grossly violating the principle of hearing and the right of the parties to testify in the proceedings. We have also already reported that criminals had to intervene during the debate because the official who conducted the proceedings brutally silenced the lawyers of the opposing parties in the proceedings. In addition to the non-governmental organization Alpe Adria Green, Nadškofija Ljubljana, represented by attorney Helena Potisk, is also fighting against the planned renovation of the Plečnik market, and for almost 20 years the civil initiative of the Municipality of Ljubljana, led by Marinka Kurilić, has been fighting with the Mayor of Ljubljana regarding his plans for an underground garage.

Advocate Golob, on behalf of Alpe Adria Green, accuses the Ministry of Natural Resources and Space of grossly violating the principle of hearing and the right to be heard by the parties in the proceedings.

The lawsuit by the NGO Alpe Adria Green, followed by the announced lawsuit by the Civil Initiative Tržnice ne damo, returns Janković's projects to the decision-making of the Ministry of the Environment, which, after four years of officials violating regulations in one way or another to please the mayor of Ljubljana, is now taking over from Svoboda Polona Rifelj from the SDS quota.

Officials shouted and insulted lawyers

On 10 June 2025, the first oral hearing was ordered in the pre-trial administrative procedure. The defendant did not allow some representatives and experts of the AAG and the civil initiative of the Marketplace to attend and participate in the oral hearing, despite the proven powers of attorney, but prevented them from doing so at the entrance, without stating the reasons, without stating the legal basis. Why this was done, has not been explained to date. This is also not explained in the contested building permit. The specific persons who ordered the attendance of the representatives and experts, Sandi Rutar and Pavlina Tsigarida, in the Ministry of Justice, were referred to the NGO in the complaint. Almost an hour before the appearance of the representative of the aforementioned party, and despite the fact that the representative of the investor (MUP) was mentioned at the entrance, the possibility of attending the oral hearing was not mentioned, and it was not accompanied by any other investors, at least on one side of the minutes of the proceedings, and not on the other side of the minutes of the proceedings.

Advocate Golob accuses the officials, Pavlina Tsigarida, Sandi Rutar and Metka Podobnik of extremely inappropriate and offensive attitude. In addition to not allowing representatives and professional assistants of the parties to be present at the hearing, they treated others who were not on the investor's side as second-rate. Personnel who were on the investor's side, i.e. Janković's MOL, did not present themselves or check whether they had powers. This shows how building permits were issued to Janković during the rule of the Svoboda Movement. Thus, officials, apparently under orders from superiors in the Ministry, even attended the hearing of persons from MOL without authorisation and without indicating who had permission.
