Scandinavian Star-dom is being prosecuted in Denmark

Den danske Søfartsstyrelsen ble frifunnet i en domstol i byen Næstved i mai. Kravet om erstatning på 450.000 danske kroner til hver av saksøkerne ble avvist.

Tirsdag opplyser advokat Lisa Edl-Dalgas fra Pramming Advokater, som representerer de 47 saksøkerne, til Ritzau at saken ankes.

159 mennesker omkom i brannen på ferja i april 1990. 136 av de omkomne var nordmenn.

Strid om kontroll

Dommen i mai konkluderte med at den danske etaten ikke hadde plikt til å gjennomføre en havnestatskontroll og at det senere ble gjort nødvendige undersøkelser av de bakenforliggende årsakene til brannen. Saksøkerne mente derimot at retten satte til side funnene i to rapporter som konkluderte med det motsatte.

I 2022 ble det framlagt en ny rapport om ulykken, bestilt av det danske næringsdepartementet. Den konkluderte med at Søfartsstyrelsen burde ha foretatt en såkalt havnestatskontroll av Scandinavian Star før ferja ble satt i ordinær trafikk, skriver Politiken.

Ifølge en rapport fra granskingsgruppen Scandinavian Star Task Force i 2024 ville en kontroll ha avdekket sikkerhetsmessige mangler ved skipet.

Kommer først opp om to år

Ankesaken kommer opp for Østre Landsret tidligst høsten 2028, ifølge Edl-Dalgas. Hun sier de 47 kommer til å framsette de samme kravene da.

Stridens kjerne da kommer til å være hvorvidt Søfartsstyrelsen kjente til at fergen var satt i rute. Scandinavian Star ble satt i trafikk 1. april, kun få dager før dødsbrannen. Blant annet hadde ikke besetningen gjennomført brann- og redningsøvelser. Fergen var da ikke klar til å seile med passasjerer, men det var ikke etaten klar over, slo retten fast i mai.

Saksøkerne mener derimot dette er feil, og viser til et dokument som viser at Søfartsstyrelsen kjente til at fergen ble satt i trafikk.

Ifølge Politiken har Søfartsstyrelsen i alle år fastholdt at de ikke hadde ansvar for å kontrollere ferja siden den var registrert på Bahamas.

Den norske kapteinen og to danske redere ble i 1991 dømt til korte straffer. En ny etterforskning ble henlagt i 2016 på grunn av mangel på bevis. En dansk lastebilsjåfør som omkom i brannen, ble utpekt som skyldig i brannstiftelse. Politiet mente imidlertid at det ikke kunne slås fast at han var gjerningsmannen, selv om det var grunnlag for mistanke.
