Premiér Andrej Babiš (ANO) opakuje, že svůj střet zájmů vyřešil vložením Agrofertu do svěřenského fondu. Státní zemědělský intervenční fond (SZIF) se s ním ztotožnil a odblokoval Agrofertu stamilionové dotace, které žádá uhradit z evropského rozpočtu .
EU to ale vidí jinak. Na konci května dorazil do Prahy dopis psaný jménem pěti generálních ředitelství Evropské komise, který zdůrazňoval, že požadavky Bruselu Česko nevyřešilo . Listina obsahovala požadavek – vláda měla do jednoho měsíce expertům Komise poslat jasnou a podloženou právní analýzu, která zdůvodňuje, zda svěřenský fond, do něhož Babiš vložil Agrofert, české i evropské paragrafy proti střetu zájmů splňuje.
Nyní je ale jasné, že se Evropská komise nedočká. Ministerstvo pro místní rozvoj Zuzany Mrázové (ANO), které je za komunikaci s Komisí zodpovědné, ostře formulované žádosti nevyhovělo. Evropské unii napsalo, že oficiálně nemá k dispozici ani klíčový statut svěřenského fondu RSVP Trust, z nějž podle mnohých expertů plyne, že Babiš je s evropskými paragrafy stále v konfliktu .
„K dispozici máme pouze verzi, která se objevila v médiích, přičemž u takového dokumentu nemůžeme potvrdit jeho správnost ani úplnost,“ napsal za českou vládu v odpovědi Evropské komisi vrchní ředitel ministerské sekce fondů EU a mezinárodních vztahů Stanislav Schneidr.
Naráží tak na text statutu, který zveřejnily Seznam Zprávy poté, co se ho premiér pokoušel utajit. Schneidr přitom nijak neobjasňuje, proč si ministerstvo nemohlo ověřenou kopii statutu vyžádat od rejstříkového soudu, kde je uložen.
„Na posouzení nemáme kompetence“
Odpověď ministerstva pokračuje obsáhlým zdůvodněním toho, proč Česko nemůže do Bruselu poslal vyzdrojovaný verdikt, zda premiér skutečně střet zájmů vyřešil.
„Podle Ústavy České republiky lze státní moc uplatňovat jen v případech, v mezích a způsoby, které stanoví zákon. Zákon o střetu zájmů, kompetenční zákon ani jiný právní předpis nebo předpis EU nesvěřují žádnému ústřednímu správnímu úřadu obecné zmocnění k vydání autoritativního nebo závazného stanoviska,“ tvrdí ministerstvo, které vede Mrázová.
„My to analyzovat nemůžeme.“ Z odpovědi Evropské komisi z pera ministerstva pro místní rozvoj.
Zároveň ale dodává, že na základě statutu, který má ministerstvo z médií, se zdá, že nové uspořádání svěřenského fondu RSVP Trust eliminuje výhrady EU proti předchozím svěřenským fondům z let 2017–2021, kterými se Babiš neúspěšně pokoušel svůj střet zájmů vyřešit, když seděl ve vládě naposledy.
Dopis se ale zcela vyhýbá komentování toho, zda nový svěřenský fond splňuje evropské předpisy, na které podle mnohých expertů pravděpodobně jeho parametry narazí.
Co říká utajený statut Babišova fondu?
Experti argumentují, že klíč obsahuje neveřejný statut fondu, který premiér Andrej Babiš tajil. Zveřejnily ho až Seznam Zprávy .
Babiš totiž sice tvrdil, že se navždy vzdal Agrofertu a jeho děti ho dostanou až po jeho smrti, reálně ale už s Babišovým koncem v politice bude fond řídit rada složená z jeho dětí. Těm navíc nic nebrání učinit Babiše správcem fondu, čím by znovu dostal pod kontrolu i Agrofert.
Chceme jasný závěr, psala Komise
Právě o to, aby takovou analýzu Česko poskytlo, přitom Evropské komisi šlo.
„Žádám vás o předání úplného právního posouzení, vypracovaného řídicím orgánem týkajícího se této společnosti v rámci skupiny Agrofert. Toto posouzení by mělo zahrnovat veškeré pracovní dokumenty, hodnoticí tabulky a podpůrné důkazy týkající se souladu se článkem 61 finančního nařízení a českým zákonem o střetu zájmů,“ vypočítal požadavky dopis z Bruselu.
„Dokumentace musí obsahovat jasný a konečný závěr, zda se má za to, že stávající majetkové uspořádání je v souladu s příslušnými právními předpisy Unie a vnitrostátními právními předpisy,“ dodává listina, pod níž je podepsán zástupce generální ředitelky pro regionální politiku Evropské komise Hugo Sobral.
Ministerstvo: možná do konce roku
Ministerstvo pro místní rozvoj požadavek odrazilo i tvrzením, že taková analýza vznikne až ve chvíli, kdy si Agrofert požádá o nějakou dotaci a vypracuje ji poskytovatel peněz.
„Posouzení splnění podmínek žádostí o podporu tedy náleží příslušným poskytovatelům, a to incidenčně pro každé řízení a s ohledem na konkrétní okolnosti případu,“ dodal v reakci vrchní ředitel Schneidr.
Evropská komise ovšem už v původním květnovém dopise jednu takovou žádost o dotaci identifikovala. Podaly ji Kostelecké uzeniny do programu, za který ručí ministerstvo průmyslu Karla Havlíčka (ANO). I v tomto případě vysoce postavený úředník Sobral do měsíce požadoval analýzu, zda konkrétně tuto dotaci s ohledem na případný střet zájmů Andreje Babiše může firma z holdingu Agrofert dostat.
Ani v tomto případě se ale Evropská komise jen tak nedočká. „Vzhledem k tomu, že dosud není ukončeno dodání podkladů od žadatele, nelze dopředu posuzovat kroky následující.
