Ikea appeals against the decision to issue a parking garage in Älmhult

Ikea has decided to appeal a court ruling that halted the construction of a temporary parking garage in Älmhult. The dispute began when neighbors successfully challenged the building permit, arguing that the temporary nature of the structure was not adequately justified. The court ruled that Ikea had not provided concrete evidence that the need for the parking garage would end within a foreseeable timeframe. In response, Ikea stated it did not have the opportunity to comment on the court's questions earlier and now seeks to clarify its position through the appeal.

Striden om det tillfälliga parkeringshuset i Älmhult fortsätter. Grannarna vann första ronden då Mark- och miljödomstolen stoppade bygget – men nu väljer Ikea att överklaga.

SVT har tidigare berättat om striden som uppstått då Ikea vill placera ett nio våningar högt parkeringshus mitt i ett villakvarter i Älmhult med ett tillfälligt bygglov. Parkeringshuset ska stå på platsen i många år medans Ikea bygger bland annat bygger Ikea Hotell på den existerande parkeringsytan.

Kommunen godkände det tillfälliga bygglovet, men grannarna protesterade högljutt. I slutet av maj stoppade också Mark- och miljödomstolen bygget, då man menade att ett tillfälligt bygglov kräver ”en konkret och realistisk alternativ lösning som innebär att behovet av den sökta åtgärden kommer att upphöra inom överskådlig tid”.

”Fick inte yttra oss”

Domstolen menar att Ikea inte har redovisat lösningar som visar att behovet faktiskt är tidsbegränsat.

Men nu väljer alltså Ikea att överklaga domen.

”Mark- och miljödomstolen vid Växjö tingsrätt anser inte att kriterierna för ett tillfälligt bygglov är uppfyllda. Eftersom vi inte fick möjlighet att yttra oss tidigare, behöver vi nu överklaga domen för att få fram våra svar på deras frågor”, skriver Ikea i ett mejl till SVT.
