Nefnd um eftirlit með lögreglu hefur vísað máli til héraðssaksóknara vegna handtöku í miðbæ Akureyrar aðfaranótt 17. júní 2023, þar sem ekki er hægt að útiloka refsiverða háttsemi sérsveitarmanns ríkislögreglustjóra.
Kvörtunin barst nefndinni frá lögmanni manns sem var handtekinn. Hann hélt því fram að hann hefði verið rifinn niður í jörðina án þess að hafa brotið af sér og að sérsveitarmenn hefðu haldið honum niðri með hné á hálsi. Bráðamóttökuvottorð staðfesti að hann hefði hlotið meiðsli við handtökuna.
Slagsmál við Ráðhústorg
Samkvæmt frásögn lögreglu hafði verið tilkynnt um slagsmál við Ráðhústorg. Þegar lögregla handtók bróður mannsins hafi hann reynt að losa hann úr tökum lögreglumanna. Þá hafi sérsveit ríkislögreglustjóra gripið inn í. Lögreglan segir manninn hafa veitt mótspyrnu, ekki hlýtt fyrirmælum og síðar þurft að halda honum niðri í fangageymslu.
Í niðurstöðu nefndarinnar kemur fram að á upptöku úr búkmyndavél lögreglumanns frá embætti lögreglustjórans á Norðurlandi eystra sjáist hné sérsveitarmanns á hálsi mannsins í nokkurn tíma. Hins vegar fundust engar upptökur úr búkmyndavélum sérsveitarmannanna sjálfra af handtökunni eða flutningi mannsins í fangageymslu.
Engar upptökur ástæða frekari meðferðar
Nefndin telur að þessar upptökur hefðu getað varpað skýrara ljósi á atvikið. Þar sem þær eru ekki til staðar og fyrir liggur myndefni sem sýnir hné á hálsi mannsins, sé ekki unnt að útiloka mögulega refsiverða háttsemi af hálfu lögreglumanns. Málinu hefur því verið vísað til héraðssaksóknara til frekari meðferðar.
