Na semana passada, a Corte de Cassação da Itália impôs ao Supremo Tribunal Federal (STF) uma das maiores humilhações de sua história. Ao negar a extradição da ex-deputada Carla Zambelli, os magistrados italianos afirmaram que a mais alta instância da Justiça brasileira cometeu o pecado mais grave de um juiz: julgar sem imparcialidade.

Na decisão, nada foi afirmado sobre a sanha persecutória de Alexandre de Moraes contra os políticos bolsonaristas. Não se acusou o ministro de agir politicamente, com más intenções ou deboche. Em termos jurídicos, a parcialidade não foi subjetiva.

Foram as condições do processo que, de forma objetiva, tornaram o julgamento de Zambelli eivado de parcialidade. Ela foi acusada de falsificar um mandado de prisão contra Moraes. O fato, por óbvio, afeta a honra do ministro. E, por isso, ele jamais poderia ter tocado nesse processo. Simples assim. Não há condições de uma atuação isenta no caso.

E pouco importa o argumento de Moraes de que o Ministério Público não imputou a Zambelli um crime contra sua pessoa, mas contra a Justiça, as instituições ou a democracia. Tampouco se trata de confiar na capacidade de distanciamento ou no desapego pessoal do magistrado.

Não é humano — nem juridicamente aceitável — esperar que qualquer indivíduo com poder de punir consiga avaliar com isenção a conduta de quem lhe causa qualquer prejuízo. Esse princípio está em todas as cartas internacionais de direitos fundamentais, na Constituição e nas leis brasileiras. Tudo isso foi atropelado por Moraes.

Com a repreensão severa da Corte italiana, qual atitude seria esperada do STF? Uma reflexão profunda sobre o brutal erro cometido e uma revisão enfática, pelos demais ministros, do que o tribunal permitiu que fosse feito contra toda sua tradição jurídica.

O que se viu foi a repetição da mesma iniquidade na condenação de Eduardo Bolsonaro nesta terça-feira (16), proferida pelos mesmos ministros que condenaram Zambelli, numa situação semelhante: o ex-deputado foi acusado de pressionar o governo americano a sancionar Moraes na Lei Magnitsky – conduta que, por evidente, causou danos ao ministro.

O que a Corte de Cassação da Itália ainda não percebeu é que tal procedimento se aplica há mais de sete anos no STF. Todas as centenas de condenações contra políticos e militantes com origem no inquérito das fake news , incluindo as sentenças do 8 de janeiro de 2023, seguem a mesmíssima lógica. Os ministros julgam seus ofensores.

Muito em breve, a própria Itália verá outro exemplo da prática. Mais um de seus cidadãos será condenado por Moraes nesse mesmo padrão. O alvo da vez é Eduardo Tagliaferro, o ex-assessor que denunciou os procedimentos do ministro na imprensa.

Ao que tudo indica, o mundo civilizado ainda não percebeu o tamanho e a gravidade do problema enfrentado no Brasil. Nos últimos anos, os ministros se empenharam em elogiar-se, em fóruns no exterior, pela “defesa da democracia”. A plateia era formada por seus bajuladores e compadres: estudantes, colegas de faculdade, advogados e políticos.

Ao lado da Itália, nações de sólida tradição jurídica e democrática, como a Espanha e os Estados Unidos, já acenderam alertas sobre o padrão das decisões de Moraes e o endosso do STF. No passado, o Brasil acolheu italianos e espanhóis em tempos de guerra, perseguição ou miséria na Europa. Hoje, são os brasileiros que precisam de socorro.
