A condenação do ex-deputado federal Eduardo Bolsonaro (PL-SP) pela Primeira Turma do Supremo Tribunal Federal (STF) é mais um golpe nas ambições políticas do filho 03 do ex-presidente Jair Bolsonaro. A sua possível permanência nos Estados Unidos, onde está desde fevereiro de 2025, pode, indiretamente, dificultar a sua participação em eleições no Brasil.
Especialista em direito eleitoral, o advogado Renato Ribeiro de Almeida explica que, caso a condenação se confirme e ele não se apresente para cumprir a pena, ficará com seus direitos políticos suspensos por estar em dívida com a justiça brasileira. “Quem tem condição penal com trânsito em julgado tem suspensão dos direitos políticos”, diz Almeida. Nesta situação, ele fica inelegível até resolver a questão ou o crime prescrever.
A intenção de continuar na política brasileira de Eduardo Bolsonaro fica clara com a nota divulgada após a condenação onde o filho do ex-presidente se coloca como um perseguido político. “Por isso o real objetivo deste julgamento sem pé nem cabeça é apenas um: tirar meu nome das eleições”, diz a nota divulgada nas redes sociais do ex-deputado. Vale lembrar que, no caso de Eduardo Bolsonaro, para isso ocorrer, ainda é necessário que os embargos da defesa sejam analisados e indeferidos, além de um mandado de prisão expedido. Uma outra fase pode envolver um pedido de extradição que passaria pelo Ministério da Justiça para chegar às autoridades norte-americanas.
Na decisão da Primeira Turma da Corte do STF, dada na última terça-feira, 16 de junho, a dosimetria da pena foi calculada em quatro anos e dois meses de prisão em regime semiaberto, com a inelegibilidade por oito anos, segundo a Lei da Ficha Limpa , contados a partir do fim do cumprimento da sentença. O tempo em que o ex-deputado ficaria sem poder se candidatar, portanto, seria de cerca de 12 anos.
Por que isso importa?
Ex-deputado federal pelo PL, Eduardo Bolsonaro pretendia sair nas eleições de 2026 como suplente da vaga ao Senado pela legenda.
Eduardo Bolsonaro também figura nas investigações que relacionam Daniel Vorcaro, dono do Banco Master, com a financiamento da cinebiografia de Jair Bolsonaro, Dark Horse.
Porém, segundo Ribeiro de Almeida, a inelegibilidade neste período de oito anos pode ser questionada na Justiça, em tese, em função do enquadramento específico do crime cometido nas hipóteses de inelegibilidade previstas pela Lei da Ficha Limpa. De acordo com o regulamento da norma, a condenação por órgão colegiado já pode produzir efeitos eleitorais antes do encerramento definitivo do processo, ou seja, antes da declaração do trânsito em julgado.
Na avaliação do advogado, contudo, seria necessário verificar se o crime de coação à Justiça no curso do processo, motivo pelo qual Eduardo foi condenado, se enquadra entre os delitos expressamente contemplados pela Lei da Ficha Limpa. Outra hipótese seria o crime de coação ser compreendido dentro do arcabouço de crime contra a administração da Justiça, que também prevê a inelegibilidade de oito anos após o cumprimento da sentença.
“Esse provavelmente será um dos temas centrais de uma eventual discussão eleitoral futura, já que a elegibilidade ou inelegibilidade é analisada quando do registro de candidatura, em agosto do ano eleitoral”, analisa Almeida.
A condenação pelo STF não gera efeitos automáticos em relação à vida de Eduardo em território norte-americano, o que significa que ele não corre risco de restrições migratórias, civis ou políticas nos Estados Unidos.
“Qualquer consequência prática dependeria de avaliação das autoridades americanas à luz de sua própria legislação migratória e de segurança nacional”, explica o advogado. O ex-parlamentar só poderá ser preso fora do país caso haja um pedido de extradição determinado pelo ministro Alexandre de Moraes. Essa decisão, porém, só cabe após o trânsito em julgado do processo.
“Caso haja condenação definitiva e interesse do Estado brasileiro, o pedido seria formalizado pelo governo brasileiro, por via diplomática, com base no tratado de extradição vigente entre Brasil e Estados Unidos. Ainda assim, a decisão final caberia às autoridades americanas, que analisariam requisitos legais, dupla tipicidade, natureza do delito e eventuais impedimentos previstos em seu ordenamento jurídico” , conclui Almeida.
