Videoen, som ligger øverst i denne saken, viser øyeblikket som har ført til at en fengselsbetjent ved Oslo fengsel er suspendert fra stillingen sin. Vedkommende er nå tiltalt for kroppskrenkelse og grov uaktsom tjenestefeil etter hendelsen, som skjedde 13. august i fjor.
Dagbladet erfarer at rettssaken starter i september.
Det var lederen i Oslo fengsel, Nils Leyell Finstad, som selv anmeldte betjenten. Det gjorde han halvannen måned etter hendelsen, ifølge TV 2 , som avslørte saken.

- Den videoen gjør inntrykk på meg. Det gjør den, helt klart, sier Finstad til kanalen.
Betjenten: - Veldig kaotisk
Den tiltalte betjenten nekter straffskyld. Han har gjennom sin tidligere forsvarer Atle Sønsteli Johansen sendt følgende uttalelse til TV 2 om sin versjon av hendelsen:
«Alt skjedde veldig fort og jeg oppfattet at de ikke hadde, eller var i ferd med å miste kontrollen på den innsatte. Jeg løp derfor til for å bistå. I ettertid er det mulig å si at jeg kanskje misforsto og at betjentene hadde bedre kontroll enn det jeg oppfattet, men situasjonen var veldig kaotisk», sier han i uttalelsen.

I fjor høst åpnet politiet etterforskning og ba om å få utlevert videoene av hendelsen.
- Det var ikke vits å gjøre motstand, sier den fornærmede mannen om voldsbruken til TV 2.
- Jeg lot bare tankene mine gå til et annet sted da jeg lå der, sier han videre.
Politiet mottok videoer
I videomaterialet politiet mottok først, manglet det vesentlige sekunder fra da den innsatte beveger seg i fellesområdet i fengselet før videoen går i frys. I neste klipp lå den innsatte på bakken med flere betjenter over seg.
Slagene var dermed ikke med i de første videoene. Seinere fikk politiet sendt over en ny og fullstendig video av hendelsesforløpet, etter å ha bedt om dette, ifølge TV 2.

Politiet mistenker ikke at Kriminalomsorgen unnlot å ta med alle detaljene i den første videoen, bekrefter politiadvokat Bendik Tveiten Vigsnes til Dagbladet.

- Videofilen har blitt behandlet av DPA (Digitalt politiarbeid) som hadde ansvaret for å gjennomgå filen. Tilbakemeldingen derfra var at det var en feil på filen, og at det ikke er mulig å si noe om feilen oppstod i forbindelse med nedlasting fra fengselets systemer til politiets minnepenn, eller om den oppstod i forbindelse med overføring fra politiets minnepenn til politiets systemer, skriver han i en e-post og legger til:

- Fengselet hadde filen sikret, og da politiet ba om denne på nytt var det ingen feil med filen. Politiet har ikke grunn til å tro at videoen var klippet.
Slagene ble utelatt
Politiet ble også tilsendt rapportene som fengselsbetjentene selv skrev etter hendelsen, opplyser TV 2.
I rapportene står det ingenting om slagene den fornærmede ble utsatt for, ifølge fengselssjefen.
Politiadvokat Vigsnes opplyser at den tiltalte mannen har forklart seg om hendelsesforløpet i avhør, men ønsker ikke å kommentere hva han har fortalt.
- Hvor alvorlig ser politiet på at en fengselsbetjent er tiltalt for kroppskrenkelse i fengsel?
- Alvoret gjenspeiles i at politiet har funnet grunnlag for å foreslå tiltale, og statsadvokaten har tatt ut tiltale i tråd med forslaget. Utover det ønsker jeg ikke å kommentere det, da dette vil bli belyst nærmere under hovedforhandlingen, skriver han.
- For mange blir skadd
Fengselssjef Finstad sier til Dagbladet at mange betjenter står i mange «svært krevende situasjoner», og at for mange ansatte og insatte blir skadd i fengsel.
- Det kan være svært krevende å vurdere alle sider av en akutt og kaotisk situasjon i sanntid. Vi har ofte for dårlig bemanning, svært mange innsatte og uoversiktlige situasjoner. Det er lettere å stille spørsmål i ettertid om utøvelse av fysisk makt fremstår som nødvendig, forsvarlig og forholdsmessig eller om en innsatt ble påført unødvendig skade eller lidelse, skriver han i en e-post.
