Pirkanmaan käräjäoikeus on tuominnut 38-vuotiaan miehen sakkoihin ja vahingonkorvauksiin Tampereella Maisansalossa viime vuoden huhtikuussa tapahtuneesta luhtitalon palosta .
Kaksikerroksisessa talossa oli 12 asuntoa, ja talo tuhoutui palossa purkukuntoon.
Mies tuomittiin yleisvaaran tuottamuksesta, sillä tulipalo lähti liikkeelle hänen polttamastaan pikkusikarista.
Mies tuomittiin 40 päiväsakkoon yleisvaaran tuottamuksesta. Lieventäväksi tekijäksi oikeus katsoi sen, että mies sai tulipalossa vaikeita palovammoja ja on edelleen niiden takia työkyvyttömänä.
Muut rakennuksessa olleet viisi henkilöä pelastautuivat ajoissa eikä heille aiheutunut vammoja.
Oikeus pohti, oliko mies huolimaton
Huhtikuussa 2025 mies oli polttanut 2. kerroksen parvekkeellaan pikkusikaria ja mennyt sen jälkeen nukkumaan.
Sikari oli jäänyt palamaan tai kytemään ja sytytti terassipöydän palamaan.
Miehellä oli terassipöydällä tuhkakuppina armeijan pakin alaosa, johon hän lisäsi kertomansa mukaan säännöllisesti vettä. Hän kuitenkin arvioi, että tuhkakuppi oli voinut kuivua, koska paikka oli tuulinen.
Käräjäoikeus katsoi miehen toimineen huolimattomasti, koska hän ei ollut riittävästi varmistunut siitä, ettei sikari aiheuttaisi tulipaloa.
Mies kiisti syyllisyytensä. Hän ei ollut mielestään toiminut varomattomasti vaan käyttänyt tuhkakuppia asianmukaisesti.
Tulipalo levisi parvekkeelta puurakenteisen luhtitalon seinään.
Palokunta ei pystynyt paikalle tulleessaan enää pelastamaan taloa.
Palosta aiheutui yli 300 000 euron suuruinen taloudellinen vahinko.
Korvauksia soviteltiin
21 asianomistajaa vaati mieheltä merkittäviä korvauksia. Mies vaati korvausvastuun sovittelua muun muassa heikon taloudellisen tilanteensa perusteella.
Käräjäoikeus katsoi kohtuulliseksi sovitella korvausvastuu noin puoleen toteen näytetyistä määristä.
Nyt mies joutuu maksamaan asianomistajille korvauksia yhteensä yli 25 000 euroa. Lisäksi hän joutuu maksamaan yhden asianomistajan oikeudenkäyntikuluja lähes 6 000 euroa.
Korvaukset koskevat lähinnä irtaimistovahinkoja, menetettyjä vuokratuloja ja vakuutuksen omavastuuosuuksia.
Vakuutusyhtiö rakentaa talon uudelleen vakuutusyhtiön kustannuksella.
Tuomio ei ole lainvoimainen.
