The Supreme Court rejected the appeal of former president of the Ljubljana District Court, Marjan Pogačnik, who had challenged his removal from office by the Judicial Council. The court ruled that the Judicial Council acted in accordance with the law when it removed Pogačnik following findings by the European Court of Human Rights regarding serious violations of judicial procedures under his leadership. Pogačnik initially sought to overturn the decision and later requested the Supreme Court to identify irregularities, but both requests were denied.

Kljub nekaterim drugačnim pričakovanjem je vrhovno sodišče vendarle zavrnilo tožbo nekdanjega predsednika ljubljanskega okrožnega sodišča Marjana Pogačnika, s katero je ta spodbijal svojo razrešitev, ki jo je sprejel sodni svet, je poročal Info360.

Vrhovni sodniki so odločili, da je sodni svet ob razrešitvi Pogačnika z mesta predsednika okrožnega sodišča v Ljubljani ravnal povsem v skladu z zakonodajo. Tako ni uspel s svojo tožbo na vrhovno sodišče, s katero je skušal sprva doseči odpravo odločbe o razrešitvi, pozneje pa je želel, da bi vrhovni sodniki “zgolj” ugotovili nezakonitosti.

Sodni svet je Pogačnika razrešil novembra lani, po tem ko je Evropsko sodišče za človekove pravice med njegovim vodenjem okrožnega sodišča ugotovilo hude kršitve pri dodeljevanju zadev sodnikom. Te niso bile dodeljevanje v skladu z načelom naravnega (naključnega) sodnika, kar je huda kršitev sodnega postopka.

Odločbo sodnega sveta je skušal Pogačnik na vsak način izpodbiti tudi, ko je sodni svet že imenoval novo predsednico sodišča, in ni bilo več možnosti, da bi se vrnil na čelo sodišča.

Po besedah poznavalcev je kazalo, da bo senat vrhovnih sodnikov tožbi ugodil in ugotovil nepravilnosti pri razrešitvi, toda kar nekoliko presenetljivo se to ni zgodilo, navaja portal.
