Ž upanijsko državno odvjetništvo u Rijeci je, nakon provedenog ispitivanja okrivljenika, donijelo rješenje o provođenju istrage protiv državljanina Republike Hrvatske i Republike Srbije (1953.) zbog kaznenog djela ratnog zločina protiv civilnog stanovništva iz članka 120. stavak 1. Osnovnog krivičnog zakona Republike Hrvatske.

Postoji osnovana sumnja da je okrivljenik 21. siječnja 1992. u jutarnjim satima u mjestu Podudbina, tijekom oružanog sukoba između regularnih postrojbi Hrvatske vojske i policije s jedinicama vojske tzv. Republike Srpske Krajine i paravojnim jedinicama, kao pripadnik vojne policije u sastavu vojske tzv. Republike Srpske Krajine počinio ratni zločin protiv civilnog stanovništva.

Osnovano se sumnja da je okrivljenik, nakon što su prethodnog dana oštećenika uhitili i pretukli pripadnici paravojnih jedinica te ga zatvorili u sobu, protivno odredbama Ženevskih konvencija za zaštitu građanskih osoba za vrijeme rata te Dopunskog Protokola Ženevskim konvencijama o zaštiti žrtava međunarodnih oružanih sukoba, u narednih osam dana otključavao vrata prostorije u kojoj je oštećenik bio zatvoren te mu zadavao više udaraca u glavu i tijelo, a prilikom puštanja na slobodu istome uputio prijeteće riječi.

Sudac istrage Županijskog suda u Rijeci prihvatio je prijedlog državnog odvjetništva te je okrivljeniku odredio istražni zatvor zbog opasnosti od bijega i opasnosti od utjecaja na svjedoke (članak 123. stavak 1. točka 1. i 2. Zakona o kaznenom postupku).
