O presidente do Supremo Tribunal Federal, Edson Fachin , rejeitou um habeas corpus protocolado para impedir o presidente Lula (PT) de eventualmente indicar mais uma vez o advogado-geral da União, Jorge Messias , a uma vaga na Corte.

Lula afirmou em 29 de maio que reenviaria ao Senado a indicação de Messias, mas não formalizou essa decisão. Ainda assim, o autor do HC alegou que insistir em uma nomeação já rejeitada pela Casa Alta violaria o devido processo legal, a separação de poderes e a moralidade administrativa.

Ao negar a solicitação, em despacho assinado em 12 de junho, Fachin explicou não haver um ato concreto — ou seja, Lula não assinou a indicação — e enfatizou que o autor do habeas corpus não se enquadra nas hipóteses a legitimarem a atuação do STF.

“Em razão da intransponibilidade de tais obstáculos, a impetração é manifestamente incabível”, concluiu o ministro. Fachin também determinou o trânsito em julgado do pedido, atestando não caber qualquer recurso.
