EMS Group saves 70 jobs: the Court of Justice gives the green light to the agreement

EMS Group has successfully completed its restructuring process with the approval of a preventive agreement by the court in Reggio Emilia. The legal aspects of the operation were handled by the CDRA law firm led by Antonino Restuccia. The first phase of the restructuring involved the sale of part of the business, which saved approximately 70 jobs. The approval allows the implementation of the restructuring plan, combining negotiation tools, extraordinary operations, and measures to ensure business continuity.

Si è concluso positivamente il complesso percorso di risanamento di EMS Group S.p.A. con l’omologazione del concordato preventivo da parte del Tribunale di Reggio Emilia.

Per tutti i profili legali dell’operazione, inclusa la gestione della procedura di composizione negoziata, la strutturazione del piano di ristrutturazione, nonché il coordinamento con l’operazione di ingresso dell’operatore industriale EMS Group S.p.A. è stata assistita dallo studio CDRA guidato dal founder partner Antonino Restuccia.

La prima fase del risanamento è avvenuta durante la composizione negoziata della crisi, nel corso della quale è stata perfezionata una prima cessione di ramo di azienda che ha consentito il salvataggio di circa 70

posti di lavoro.

L’omologazione consente ora l’attuazione del piano concordatario e conclude un percorso di ristrutturazione che ha combinato strumenti negoziali, operazioni straordinarie e misure di continuità aziendale.
