Luego de las denuncias de embargo de cuentas bancarias de deudores del Crédito con Aval del Estado (CAE) por parte de la Tesorería General de la República, un grupo de diputados opositores presentó en el Congreso un proyecto de ley para resguardar la inembargabilidad de las remuneraciones de los afectados.

La iniciativa, denominada “ley sueldos protegidos”, es respaldada por los diputados Daniela Serrano, Nathalie Castillo Luis Cuello, Marcos Barraza y Boric Barrera, del Partido Comunista (PC), Emilia Schneider del Frente Amplio (FA), Ana María Gazmuri de Acción Humanista, el socialista Juan Santana, Paula Olmos del Partido de la Gente (PDG) y Patricio Pinilla (Democracia Cristiana).

El proyecto busca modificar el Código del Trabajo, con la finalidad de evitar los embargos de las cuentas bancarias ante deudas como la del CAE.

De acuerdo con los impulsores de la moción parlamentaria, el Ministerio de Hacienda, a través de la Tesorería General de la República, han afectado a los deudores del CAE y “han expuesto a miles de profesionales y técnicos a una situación de extrema vulnerabilidad patrimonial”.

En el antecedente general del proyecto de ley, se señala que las medidas de cobro “justificadas bajo la premisa técnica de la ‘recuperación de activos’, estas cobranzas masivas omiten deliberadamente la precariedad del mercado laboral actual y la imposibilidad fáctica de pago de un alto porcentaje de los deudores”.

Asimismo, refuerzan que “el artículo 57 del Código del Trabajo consagra el principio matriz de la inembargabilidad de las remuneraciones de los trabajadores como una garantía mínima de subsistencia familiar, admitiendo el embargo solo de forma excepcional sobre la parte que exceda las 57 Unidades de Fomento (unos 2 millones 322 mil pesos a este lunes)”.

Con todo, el proyecto plantea agregar un artículo único al Decreto Fuerza Ley N°1 que establece el Código del Trabajo, agregando un inciso final al artículo 57.

“La inembargabilidad de las remuneraciones definidas en el artículo 41 subsistirá íntegramente y conservará su naturaleza jurídica de tal para todos los efectos legales , sin que dichos fondos puedan ser considerados activos o saldos sujetos a compensación, aun cuando sean depositados o transferidos en la cuenta bancaria, vista o de ahorro que el trabajador informe a su empleador y a la institución depositaria para tales fines”, se lee en el proyecto.

Se agrega que “esta protección será oponible a cualquier acreedor y se extenderá hasta el límite señalado en el inciso primero. Para efectos de esta protección, el origen remuneratorio de los fondos se acreditará mediante el respectivo comprobante de pago o la glosa de transferencia bancaria del empleador, cuya verificación recaerá en la institución depositaria”.

Justificación del proyecto “sueldos protegidos”

Al respecto, la diputada Daniela Serrano (PC) , autora del proyecto, señaló que “es importante hacer ver que el ministro (de Hacienda, Jorge) Quiroz y este gobierno, son los responsables de que la Tesorería esté embargando sueldos de deudores del CAE”.

“El ministro Quiroz no ha sido capaz de sostener que es a aquellas personas que ganan menos de $3,5 millones no hayan sido embargadas, es decir, se aplicó un vaciamiento de cuentas bancarias a familias chilenas que en estos momentos no tienen idea de cómo llegar a fin de mes ”, señaló Serrano.

En esa línea, defendió que el proyecto de ley se presenta “para que no exista una interpretación mañosa de la Tesorería , que pueda resguardar la inembargabilidad de los fondos que ya están protegidos por el artículo 57 de Código del Trabajo”.

“Es decir, lo que queremos hacer extensiva, es que este embargo de los sueldos sea ilegal, sobre todo cuando se encuentre en las cuentas bancarias”, explicó, agregando que “la Tesorería no puede hacer una interpretación diciendo que no sabía que eran los sueldos o que no sabían que eran las 56 UF ya consagradas como inembargables”.

Por su parte, la diputada Emilia Schneider (FA) calificó el comportamiento del gobierno, a través de la TGR, como “ inmorales y una verdadera vulneración de derechos”.

“El gobierno insiste en culpar a las personas que no pueden pagar la deuda del CAE, por una política pública que fracasó, porque el CAE fue un fracaso del Estado. Un despilfarro de recursos para el fisco, un estrés financiero para las instituciones de educación superior y un abuso para las familias chilenas”.

En esa línea, Schneider planteó como solución a la deuda, eliminar el mecanismo del CAE y “condonar estas deudas” y elaborar un mecanismo que considere el “derecho a la educación”.

A su vez, el diputado Juan Santana (PS) compartió cifras respecto de la evasión tributaria empresarial, señalando que “aquí funciona nuestro país, y particularmente este gobierno, como la ley del embudo. Ancho para los empresarios, restringido para los trabajadores”.
