Komaj petmesečni zakon se je za 27-letno Filipinko Marvil Facturan končal tragično. Nekaj dni po predlanskem božiču jo je mož Mitja Kocjančič brutalno pokončal v njunem stanovanju na Bledu. Kranjska okrožna sodnica Nina Prosen ga je danes obsodila na 12 let zapora.

Pošiljal jim je denar

Dvaintridesetletni medijski tehnik ter motivacijski govorec in diplomantka turističnega menedžmenta, rojena v San Juanu, sta se spoznala februarja 2024 prek spleta. Med njima je preskočila iskrica in poleti jo obiskal na Filipinih, kjer sta 12 dni počitnikovala na idiličnem otoku Palawan.

Iz njegovih izpovedi v preiskavi in na prejšnjih obravnavah naj bi ga ona nagovorila k poroki. "Rekla je, da bo tako lažje zaradi papirjev. Imel sem že nekaj razmerij, ampak še nikdar nisem imel tako močne želje, da bi koga osrečil, kot pri njej," je pojasnjeval Kocjančič in dodal, da je imela njegova izvoljenka težave s svojimi domačimi: "Bila je nezakonska in imela dve polsestri. Želela je postati stevardesa, delala pa je kot računovodkinja, dokler avgusta predlani ni izgubila službe. Mama ji je jemala denar. Pošiljal sem jim 240 evrov na mesec, pa jim to ni bilo dovolj."

V vrtcu se je bal, da mu bo izpadlo oko

Kot je povedal, se že od majhnega bori s psihičnimi težavami: v vrtcu se je bal, da mu bo izpadlo oko, pri trinajstih je bil že prvič na psihiatriji, kasneje pa je bil prepričan, da ga bo ubil najboljši prijatelj. "Ves čas me je bilo tudi strah, da se bo mojim najbližjim zgodilo kaj hudega, da bodo umrli. Jemljem različna zdravila, med drugim helex."

Zaneslo ga je tudi v mistične blodnje, denimo, da so demoni povezani z jezuiti, ki da skupaj s prostozidarji orkestrirajo vse vojne in ljudi menjajo z dvojniki. Zamenjali naj bi tudi Facturanovo: "Ko sem bil v Sloveniji, ona pa na Filipinih, me je vsak dan izsiljevala. Mislil sem, da se bo vse uredilo, ko pride sem. Toda obnašala se je zelo različno, enkrat je bila do mene prijazna, drugič me je zaničevala, enkrat je rekla, da mi bo med spanjem prerezala vrat. Drugič sem jo videl, kako pred ogledalom vadi nasmeh. Izgledala je drugače, nekako hladno, tuje, ni bila več ona. Pravo Marvil so ubili jezuiti, jaz pa sem jo imel še naprej rad."

Kar 27 vbodov v telo

Da jo je usodnega večera udaril po glavi z ročno utežjo, nato pa 27-krat zabodel v prsni koš in trebuh ter trikrat porezal po vratu, se ne spominja: "Pred očmi imam samo dve sliki, da sem s tal videl njene noge, ki so visele čez rob postelje, in potem njo. Ležala je na hrbtu. Mislil sem, da bo, če jo obrnem na trebuh in spet nazaj na hrbet, spet v redu. Ni bilo. Šel sem v kopalnico in se turširal izmenično z vročo in hladno vodo, nato pa se odpeljal v Begunje in jih prosil, naj nekaj naredijo z menoj, da ne bom več nevaren."

Sojenje se je vrtelo predvsem okrog Kocjančičevega duševnega stanja ob dogodku. Tožilka Vesna Primožič mu je očitala uboj v stanju bistveno zmanjšane prištevnosti zaradi mejne duševne motnje, njegova zagovornica, odvetnica Mojca Jarc , pa skušala s pomočjo strokovnega sodelavca, psihiatra Mladena Vrabiča , dokazati, da je bil povsem neprišteven.

Tožilka predlagala 14 let zapora

Primožičeva se je v današnji zaključni besedi oprla predvsem na strokovno mnenje psihiatričnega izvedenca Mihe Derganca : "Obdolženi je skušal dokazati, da je imel blodnje. Toda mističnih pojmov, demonov in prostozidarjev, takoj po dogodku v psihiatrični bolnišnici Begunje ni omenjal, prvič je o njih spregovoril šele januarja lani. Na mariborski forenziki so celo ocenili, da simulira. Izvedenec Derganc je postavil diagnozo čustveno neuravnovešene mejne motnje, zavrnil pa mnenje sodelavca obrambe Vrabiča, da obdolženi trpi za blodnjavo motnjo in Capgrasovim sindromom (redka psihiatrična motnja, pri kateri je bolnik prepričan, da je bila njemu bližnja oseba zamenjana z dvojnikom, op. a.). Kratke psihotične epizode sicer ni izključil, vendar po njegovem ni bila dokazana hujša simptomatika. Zato sledim njegovemu mnenju, da je bil obdolženi ob dejanju bistveno zmanjšano prišteven in zanj predlagam 14 let zapora ter podaljšanje pripora zaradi ponovitvene nevarnosti."

Zahtevajo 150.000 evrov odškodnine

Pooblaščenka Marviline matere, odvetnica Katarina Bradaška , se je strinjala s tožilko in kritizirala izvedenca Vrabiča, češ da je bilo njegovo zaslišanje mučno: "Do izvedenca Derganca je bil celo žaljiv in je v neskončnost polemiziral z vsakim njegov stališčem. Ni pa znal pojasniti, zakaj so bile metode obeh izvedencev, tudi Mateja Kravosa , napačne."
