The House on Tuesday advanced a nearly $70 billion budget reconciliation package that would fund Immigration and Customs Enforcement (ICE) and Border Patrol.

The lower chamber approved a rule 213-211 that tees up debate and a final vote on the GOP measure.

The rule briefly appeared in trouble as Reps. Chip Roy (R-Texas), policy chair of the far-right House Freedom Caucus, and Tim Burchett (R-Tenn.) voted “no.” A number of other hardliners, including members of the House Freedom Caucus also had not voted.

They huddled with Speaker Mike Johnson (R-La.) and House Majority Leader Steve Scalise (R-La.), with Roy appearing visibly frustrated as he spoke to other members of the Freedom Caucus.

Many members in the huddle were withholding votes as they sought commitments on codifying more of Trump’s border policies, according to a source familiar.

Ultimately, Roy and Burchett flipped their votes and other hardliners voted “yes.”

Republicans had already blown past President Trump’s self-imposed June 1 deadline to get the bill to his desk, after GOP division over a so-called “anti-weaponization” fund led the Senate to delay action on the measure. The fund would pay out people who believe they were unfairly targeted or prosecuted under the Biden Department of Justice.

Acting Attorney General Todd Blanche told lawmakers the Justice Department was not moving forward with the fund — remarks undercut by Trump, who said the fund “was a beautiful thing.”

But while some Senate Republicans pushed hard for language in the bill that would bar the Trump administration from creating the fund, the final product ultimately did not include such provisions. It passed the Senate early Friday morning.

Speaker Mike Johnson (R-La.) can only afford two GOP defections on final passage of the bill, assuming all members are present and Democrats are unified in opposition.

Rep. Kevin Kiley (I-Calif.), an independent who caucuses with Republicans, told reporters on Tuesday that he is leaning no on the bill.

“I would need to see bipartisan reforms to interior immigration enforcement, which I think have strong bipartisan support – I think are supported by the vast majority of Americans. So, unless something drastic happens, then I wouldn’t even consider voting yes,” Kiley said.

Republicans opted to fund ICE and Border Patrol through the reconciliation process — which allows Republicans to bypass a filibuster — after negotiations with Democrats on immigration enforcement reforms failed to produce an agreement.

House Minority Leader Hakeem Jeffries (D-N.Y.) blasted the reconciliation bill in a presser on Monday, arguing that House Democrats will be a “hard no” on the legislation.

“We believe that taxpayer dollars should be used to make life more affordable for the American people, not give ICE another $70 billion blank check so they can unleash brutality on American citizens and violently target law-abiding immigrant communities,” Jeffries said.
