Komentarišući slučaj ubistva u restoranu "27" na Senjaku, odnosno upletenost sada već bivšeg načelnika beogradske policije Veselina Milića , sagovornica N1 smatra da je to skandal ozbiljnih razmera - i za, kako kaže, ostavku ministra unutrašnjih poslova (Ivica Dačić), ali i za pad Vlade.

"Umesto ostavki, srećemo se svaki dan sa kontradiktornim obaveštenjima koja stižu iz nadležnog Višeg javnog tužilaštva, sa ciljem da javnost na kraju odustane od interesovanja za to što se desilo. Naposletku, odustaje se i od prvobitno opisanog činičnog stanja. Da se razumemo, javni tužilac nije vezan za činično stanje koje je opisano u krivičnoj prijavi, te može da odbaci krivičnu prijavu u bilo kojoj vazi postupka, pa i na početku, kao što se sada desilo", objašnjava Violeta Beširević .

Međutim, kako dodaje, ono što je zbunjujuće i kontradiktorno jeste da se sama policija, odnosno organi - pa čak i predsednik Srbije Aleksandar Vučić - su se osvrćali na to činjenično stanje koje je prvobitno opisano.

"U Milićevom slučaju, ostala je ozbiljna sumnja za krivično dela neprijavljivanje krivičnog dela ili učinioca, a to nije delo malog značaja, pogotovo kad je reč o službenom licu. Šta će od toga svega bti, ostaje da se vidi. Mislim i da su advokati koji učestvuju u ovom postupku dosta zbunjeni, a da ne govorim o građanima", rekla je sagovornica N1.

Upitana da li se sve ove informacije iz VJT-a plasiraju zbog interesa građan, odnosno kako bi oni bili obavešteni - Beširević pak smatra da obaveštenja imaju za cilj "zamagljivanje" percepcije javnosti.

Kako dodaje, problematično je i to što se igra sa "postojanjem dokaza", jer "prvi put se načelnik policije trereti da je on učestvovao u uništavanju dokaza, a onda se kaže da nema dokaza da je u tome učestvovao".

"To je velika manipulacija. Jednostavno, u interesu države je da se što pre zaboravi taj postupak, a na kraju će se on završiti u 'neodređeno' vreme", kazala je Beširević.

"Mrdićevi zakoni" - saplitanje sopstvene noge

Upitana o i te kako osporavanom - što na unutrašnjem, što na spoljašnjem nivou - setu izmena i dopuna pravosudnih zakona, odnosno tzv. Mrdićevim zakonima , sagovornica N1 ističe određeni fenomen u vezi celog tog procesa.

"U dosadašnjim postupica produženja Evropske unije, onaj fenomen koji je poznat jeste da država članica sapliće, otežava ili uslovljava uslove za pridruživanje nove države članice, obično zbog pitanja koji tereti njihove bilateralne odnose. Tako je bilo u slučaju kada je Slovenija uslovljavala Hrvatsku. Usvajanjem 'Mrdićevih zakona' svedočimo jednom ređem fenomenu, a to je sopstveno saplitanje države kandidata na putu ka EU", napominje Beširević.

Kako objašnjava Beširević, "Mrdićevi zakoni" predstavljaju veoma intenzivan napad na "teškom mukom osvojenu samostalnost pre svega tužilaštva , ustavnim amandmanima iz 2021. godine".

"Tada se u velikoj meri raskida sa staljinističkom strukturom u funkcionisanju tužilaštva. Nismo mi obezbedili potpunu samostalnost tužilaštva, kao ni nezavisnost tužilaštva, što je novi standard u pravu u EU, ali smo uspeli da napravimo polukorak i da uvedemo neke garancije koje čuvaju samostalnost tužilaštva. 'Mrdićevim zakonima' se to ograničilo", smatra sagovornica N1.

Kako dodaje, ceo ovaj proces je sa mišljenjem Venecijanske komisije u vezi usvojenih zakona, po njoj, je neuobičajen - ali, kako kaže, ništa u vezi Srbije tokom vladavine aktuelnog režima nije uobičajeno.

"A slobode izražavanja nema bez dobro obaveštenog građanina, odnosno javnosti. A funkcija obaveštavanja jeste u medijima i novinarima. Napadaju se oni novinari koji pokušavaju da svoj posao vrše sa integritetom. Zabranjuje se i napada poslednji kanal koji nam pruža potrebne informacije, koje su nam potrebne da bi doneli odgovarajuće odluke, pre svega na izborima kada građani i vrše vlast", zaključuje Beširević.

Šta su tzv. Mrdićevi zakoni?

Podsećamo, aktuelna vlast je krajem januara donela novi set pravosudnih zakona, odnosno paket od pet izmena i dopuna, nazvanog po predlagaču Uglješi Mrdiću, poslaniku vladajuće Srpske napredne stranke (SNS) u Skupštini Srbije.

Izmene i dopune obuhvatale su: Zakon o Visokom savetu tužilaštva, Zakon o sedištima i područjima sudova i javnih tužilaštava, Zakon o organizaciji i nadležnosti državnih organa za borbu protiv visokotehnološkog kriminala, Zakon o javnom tužilaštvu i Zakon o sudijama.
