Het Openbaar Ministerie denkt bij achttien personen te kunnen bewijzen dat zij zijn overleden door middelen die zijn verkocht via de website Funcaps. Dat heeft het OM vandaag tijdens een inleidende zitting gemeld in de rechtbank in Zwolle.
Daarnaast worden nog vier andere sterfgevallen onderzocht, aldus de officier van justitie. Het OM onderzocht 80 sterfgevallen die mogelijk verband houden met de verkochte middelen door de website. Voor de andere sterfgevallen heeft het OM onvoldoende hard bewijs gevonden om een verband te kunnen maken.
Funcaps verkocht via een website verschillende middelen, waaronder bromazolam (een kalmeringsmiddel), O-DSMT (een pijnstillende stof) en 2F-ketamine (een verdovende drug). Er werden volgens het OM geen bijsluiters of gebruiksinformatie meegeleverd en de verkoop werd gestimuleerd met kortingsacties en samengestelde proefpakketten.
De Nederlandse eigenaren van Funcaps, Jord van W. (31) en Stefan P. (30), begonnen tijdens de coronaperiode met de verkoop van neppillen in België. Volgens justitie waren ze niet goed op de hoogte van de wetgeving in België en wisten ze ook niet precies wat ze verkochten. De gezondheidsrisico's rond het gebruik legden ze vervolgens bij de klanten neer.
Vijf jaar cel geëist
In België kregen de twee in hoger beroep een celstraf tot drie jaar, waarvan achttien maanden onvoorwaardelijk, voor de illegale handel in medicijnen en drugs. Ook legde het hof geldboetes op en er werd een groot bedrag aan vermoedelijke inkomsten verbeurd verklaard, wat betekent dat op die geschatte inkomsten beslag wordt gelegd. Het hof oordeelde dat de verdachten bewust risico's hebben genegeerd bij de verkoop aan Belgische klanten.
Het Belgische Openbaar Ministerie had in hoger beroep vijf jaar cel geëist en wees daarbij onder meer op een overlijden in 2021 waarbij een verband werd gelegd met via Funcaps gekochte middelen. De zaak ligt in België inmiddels in cassatie bij het Hof van Cassatie, waar wordt gekeken naar mogelijke juridische of procedurele fouten.
