Mangiones advokater har informert dommeren Gregory Carro om at de vil forsøke å bevise at Mangione led av «ekstrem følelsesmessig forstyrrelse» da han angivelig skjøt og drepte sjefen i helseforsikringsselskapet UnitedHealthcare, Brian Thompson.

Dette er ikke det samme som å erklære seg utilregnelig slik at man ikke kan dømmes til straff, men i stedet overføres til psykisk helsevern.

Ved å bruke dette som forsvar vil Mangione i praksis innrømme at han tok livet av Thompson, men argumentere med at det var formildende omstendigheter. Hvis en jury sier seg enig i Mangiones framstilling, kan han bli dømt for drap – men ikke overlagt drap. I så fall får han trolig kortere fengselsstraff i rettssaken mot ham på delstatsnivå.
