Der Mann war von 2011 bis 2026 als Polizeivollzugsbeamter für das Land Berlin tätig. Er bewarb sich 2025 für die Zulassung zum Studium für den gehobenen Dienst und erhielt eine vorläufige Einstellungszusage. Das Studium sollte am 1. April 2026 beginnen.

Der Polizist legte daraufhin sein Mandat in der Gemeindevertretung nieder und suchte um Eilrechtsschutz nach. Er gab unter anderem an, die Entwicklungen der AfD Brandenburg, die seit 2020 vom Verfassungsschutz als Verdachtsfall geführt und seit 2025 als gesichert rechtsextreme Bestrebung eingestuft wird, nicht in ihrer Tragweite erkannt zu haben. Er betonte laut einem Gerichtssprecher, nicht in überörtliche Parteistrukturen eingebunden gewesen zu sein. Die AfD Brandenburg ist vom Verfassungsschutz 2025 als gesichert rechtsextreme Bestrebung eingestuft worden.
