SUD U MÜNCHENU presudio je da se Google može smatrati izravno odgovornim za netočne odgovore koje generira njegova funkcija "AI sažetak" (AI overview). Pravni spor proizašao iz tužbe dviju izdavačkih kuća bio je usredotočen na pitanje treba li se na tu uslugu primjenjivati isti pravni tretman kao i na konvencionalne rezultate pretraživanja, piše DW .

Okružni sud I u Münchenu donio je odluku povodom tužbi koje su protiv internetskog diva podnijele dvije izdavačke kuće sa sjedištem u tom gradu. Googleova funkcija sažetka pogrešno je povezala njihove tvrtke sa sumnjivim poslovnim praksama, pretplatničkim zamkama i prijevarnim shemama. AI je tužitelje povezao s informacijama o drugim, doista sumnjivim tvrtkama i izmislio veze koje ne postoje.

Google se branio tvrdnjom da nije sam odgovoran za obradu podataka te da sadržaj trećih strana prikazan u sažetku nije usvojio kao vlastiti. Sud je, međutim, odlučno odbacio takvu argumentaciju. U presudi stoji da AI sažetak ne prikazuje samo rezultate pretraživanja niti na njih upućuje, već predstavlja zaseban sadržaj koji se može pripisati samom operateru tražilice.

Obrana se pozivala na postojeću sudsku praksu njemačkog Saveznog vrhovnog suda, koja štiti operatore tražilica od izravne odgovornosti za jednostavno navođenje sadržaja trećih strana. No, sud je utvrdio da se to ne odnosi na Googleov AI alat.

Zašto AI sažetak nije isto što i rezultati pretrage?

Budući da umjetna inteligencija sažima rezultate vlastitim riječima, procjenjuje njihov sadržaj i predstavlja ga u strukturiranom obliku, suci su zaključili da Google stvara potpuno nove, neovisne izjave koje nadilaze puko navođenje poveznica.

Sud je također odbacio Googleovu obranu da korisnici mogu sami provjeriti izvore putem poveznica te da su ionako svjesni kako se "informacijama generiranim umjetnom inteligencijom ne smije slijepo vjerovati".

Suci su naveli da AI sažetak predstavlja "samostalnu izjavu s neovisno razumljivim sadržajem". Sud je utvrdio da čitatelju nije dana nikakva naznaka o nepouzdanosti sadržaja. Sud je naložio Googleu da prestane širiti lažne tvrdnje i da snosi 80% sudskih troškova.

Glasnogovornik Googlea izjavio je: "Značajno ulažemo u kvalitetu AI sažetaka kako bismo osigurali da velika većina odgovora pruža točne informacije." Iz tvrtke su poručili da će se žaliti na presudu, koja još nije pravomoćna.
