A court in Ireland has been informed that only three of nearly 2,000 investors have stepped forward to claim their share of a nearly €2 million windfall derived from litigation and tax refunds tied to an investment fund currently being liquidated. The High Court in Dublin heard that the fund, managed by State Street Custodial Services (Ireland) Ltd, holds approximately €1.7 million in assets that are to be distributed among 485 individual investors and 1,429 corporate entities. Despite extensive outreach efforts spanning over a decade, the majority of eligible parties have remained unresponsive. The trustee of the fund, State Street Custodial Services (Ireland) Ltd, filed a request with the court two weeks prior to deposit the total amount of €1.712 million into the court’s custody. None of these individuals had appeared in person during the legal proceedings. Judge Brian Cregan expressed surprise at the minimal engagement from potential beneficiaries, noting his astonishment at the lack of response even after the trustee's long-term outreach efforts. The court approved the motion to place the funds under its jurisdiction, specifying that the amount should be converted into euros based on the current exchange rate. The judge permitted further notifications to be sent via post, email, or the trustee’s website, but ruled against using newspaper advertisements due to their high cost and potential impact on the available funds. The trust in question, Putnam World Trust, operates as an umbrella unit trust established in February 2000. It consists of several sub-funds, some of which still hold active authorizations from the Central Bank of Ireland. Others have had their authorizations revoked. Certain of the revoked funds contain monies collected from class action lawsuits and tax reclaim processes conducted prior to the appointment of the new fund manager, Carne. According to the court documents, of the 485 individual investors, 138 are entitled to receive more than $250 each, while the remaining 289 will get less than that sum. In contrast, among the 1,429 corporate entities, 1,291 are set to receive less than $250 per entity, whereas 138 are due more than that amount. The court’s decision underscores the challenges faced by trustees managing legacy funds, particularly when dealing with a large and diverse group of stakeholders who may have lost touch with the investment vehicles they once participated in. The situation highlights the complexities of winding down financial instruments that have been dormant for extended periods, often leaving behind a trail of unresolved claims and unclaimed assets. The trustee has indicated that additional measures might be considered to ensure that all eligible investors are aware of the opportunity to claim their share of the proceeds. These actions aim to prevent the funds from being left unclaimed indefinitely, which could result in the assets being transferred to the state or other designated entities under Irish law. The court’s involvement ensures that the distribution process adheres to legal standards and provides a structured mechanism for resolving outstanding claims.
