Kitajske družine izgubijo sodni spor zaradi javnih univerzalnih pristojbin

Mainland Chinese families who had sought to challenge a policy affecting their children's access to subsidized university education in Hong Kong have lost their legal bid. A group of 87 families, who had come to Hong Kong under talent visa schemes, failed in their attempt to overturn the government’s revised rules regarding eligibility for public university funding. The High Court ruled on Friday that the Education Bureau’s requirement, mandating at least two years of residency in Hong Kong for children of such parents to qualify for subsidized tuition starting in 2028—was not irrational. The policy change, announced in July 2025, aimed to tighten eligibility criteria for dependant students. It introduced a one-year residency requirement for applications during the 2027–2028 academic year as part of a gradual tightening process. Families argued that this rule unfairly restricted access to affordable higher education for their children, particularly given the current system allowing minor dependants to qualify as local students and pay significantly lower tuition fees. Judge Russell Coleman presided over the case and emphasized that challenging government policy decisions typically falls outside the scope of judicial intervention unless there is a clear issue of illegality. He stated that if he had overturned the policy, it would likely lead to the same decision being made again by officials. This sentiment underscored the court’s reluctance to interfere with administrative discretion in matters of public policy. Under the existing framework, students who arrive in Hong Kong as minors and hold dependant visas or entry permits are classified as local residents. They are eligible for government-funded programs and pay approximately HK$47,000 per year in tuition fees. In contrast, non-local students face much higher costs, with annual fees reaching around HK$141,000. Some non-local families have opted to send their children to study on the mainland, where they can sit for the Diploma of Secondary Education (DSE) exams required for university admission. These students are often referred to as “examination immigrants,” highlighting the broader implications of the policy on educational mobility. The ruling reflects the judiciary’s deference to executive authority in shaping immigration and education policies. Judge Coleman acknowledged that the policy had been thoroughly considered by authorities and that the court did not have the constitutional power to reassess its validity unless there were specific legal grounds for doing so. This stance aligns with previous interpretations of judicial boundaries in similar cases, reinforcing the notion that courts generally avoid second-guessing governmental decisions on policy matters. The decision has sparked discussions among educators, legal experts, and families affected by the policy shift. While some argue that the residency requirement could deter international students from choosing Hong Kong as a destination for higher education, others contend that it is necessary to ensure fair resource allocation and maintain the quality of public services. The government maintains that the policy adjustments are designed to balance accessibility with sustainability, ensuring that public funds are used efficiently. Looking ahead, the outcome of this case may influence future legal challenges related to immigration and education policies. As the residency requirements take effect, further scrutiny of their impact on student populations and institutional resources could emerge. For now, the ruling stands as a definitive statement on the limits of judicial oversight in policy-making, leaving the responsibility of refining these regulations to the relevant authorities.
