The whistleblower, Fiona O’Neill, served as the “de facto CEO” of the Waterford Intellectual Disability Association (WIDA) until her position was effectively undermined by internal conflicts and what her legal team described as a biased organizational review. The dispute began in early 2022, when Ms. O’Neill informed the board of her concerns regarding bullying and harassment directed at the charity’s then-chairman. She requested that these allegations be treated as a protected disclosure, a legal mechanism designed to protect employees who expose wrongdoing. The board responded by engaging an external human resources consultant to conduct an “organizational review.” However, the scope of the inquiry expanded significantly, leading to a comprehensive restructuring of the organization, including the creation of a new CEO role, effectively demoting Ms. O’Neill, who had previously held the most senior managerial position. Her legal team, represented by Shaun Boylan BL, argued that the review exceeded its initial mandate and produced recommendations that were both unjustified and potentially damaging to the organization. Among these recommendations was the elimination of several key roles, including that of the HR manager and corporate governance officer, both of whom were reportedly in conflict with the chairman. This move, along with the demotion of Ms. O’Neill, led to further tensions within the organization. Compounding the situation, Ms. O’Neill discovered that the chairman had instructed her to settle a €33,000 invoice raised by the external consultant using charity funds. When she inquired with the Health Service Executive (HSE), she found that the claim was not authorized. Subsequently, two additional invoices totaling nearly €33,000 were presented, raising concerns about improper financial practices. Ms. O’Neill noted that the total amount of the three invoices matched the original sum, suggesting possible attempts to bypass financial controls. Invoices exceeding €25,000 require approval through formal procurement procedures, which were not followed in this case. In response, Ms. O’Neill alerted the HSE in February 2023, expressing concerns about improperly procured services. Later that year, she made further disclosures to the Charities Regulator and the National Office for Protected Disclosures. These actions triggered a series of confrontations with the chairman, culminating in an email in March 2023 demanding payment of the outstanding invoices. The WRC’s findings concluded that the chairman, referred to only as “EC” in the records, had engaged in behavior that interfered with the management of the organization. This included directing Ms. O’Neill to assist him during the Farrelly Commission, an official inquiry into alleged abuse in foster care settings. Her legal team argued that such involvement was inappropriate given her role as a potential witness. The WRC ultimately ruled that the charity had failed to uphold the protections afforded to whistleblowers under the 2014 legislation. As a result, WIDA was ordered to pay Ms. O’Neill the unprecedented sum of over €320,000. The decision reflects the commission’s commitment to enforcing accountability and ensuring fair treatment for individuals who raise concerns about misconduct within organizations.
