Confronting her, he found her surprised and was later confronted by Ferrel and his associate, Sandesh Moothee Ram, who pushed him before security intervened. The witness said he repeatedly asked Maharaj to choose between continuing their relationship or being with Ferrel. When she didn’t decide, he ended the relationship but maintained a friendship with benefits. They continued to meet and remain intimate, though the relationship eventually ended. In a moment of intoxication, the witness called Maharaj and made a vulgar remark, claiming he wasn’t worried about any “mother.” The next day, he received multiple calls from Ferrel, who accused him of insulting his mother. Despite offering an apology, Ferrel rejected it and escalated the threats, promising to visit his workplace to confront him. The witness said he avoided work due to fear but continued receiving calls from Ferrel, who allegedly searched for him at his place of employment. During the trial, Ferrel Govender was observed taking detailed notes and paying close attention to the witness’s testimony. His brother, Darren, sat in the dock wearing sunglasses, appearing relaxed, and occasionally smiled or laughed. This behavior drew attention from the court, prompting the judge to remind the accused to avoid expressive gestures during proceedings. The trial took a turn on Wednesday when the court received a stern warning from Senior State Advocate Krishen Shah regarding intimidation of journalists. The warning came after reports that Darren Govender and a supporter, identified as a pastor, had approached a journalist outside the courtroom. Darren, who is on bail, reportedly expressed dissatisfaction with a report that described his demeanor during the trial. The pastor, visibly agitated, accused the journalist of publishing false information and threatened legal action, stating, “I’m going to sue you.” After some negotiation, the pastor agreed to provide the journalist with contact details for his complaint. Advocate Christo van Schalkwyk SC, representing Darren, informed the journalist that the pastor intended to apologize. Judge Mbuzeni Mathenjwa emphasized that while the public has the right to attend court proceedings, this right must be exercised responsibly. He warned that anyone engaging in intimidation or interfering with journalists would face consequences, either through police intervention or expulsion from the court. The judge noted that any unlawful activity outside the courtroom would be handled by law enforcement. Further developments emerged as the court played a recording of a telephone conversation between Ferrel Govender and the witness. In the recording, Govender is heard repeatedly insulting the witness, threatening to ruin his business and vehicle, and declaring, “You’re going to die, you .” Another recording showed Govender rejecting an apology from the witness and vowing to “show you who I am.” He also threatened to kill the witness, comparing his fate to that of his late father, who died in a drive-by shooting in 2007. Video footage was presented in court depicting armed security personnel from Pro Secure, Govender’s former company, outside the witness’s business premises. The witness said he applied for a protection order against Govender but was unable to serve it because Govender was out of the province. Subsequently, he received an anonymous SMS instructing him to serve the order at a location he believed to belong to Ferrel. As the trial continues, the court has reiterated its commitment to maintaining order and ensuring fair proceedings.
