Recently, just before the trial, officials claimed they had updated policies to prioritize elderly inmates for cooler accommodations. This led to Tiede being removed from the case, as he was deemed too young for the new criteria. The Texas Department of Criminal Justice (TDCJ) uses a "heat-sensitivity score" to determine which inmates should be placed in air-conditioned cells. This score is calculated using a complex algorithm that considers medical conditions and medications. However, critics argue that the system is flawed and fails to adequately protect those most at risk. According to a federal judge, the system is "arbitrary, inadequate, and ineffective." The judge noted that even individuals with known health risks, such as a 90-year-old with hypertension, might not qualify for a score. In 2018, a landmark ruling in Cole v. Collier mandated that the TDCJ provide cooled housing for individuals with specific health conditions. Instead of implementing this order comprehensively, the department created a scoring system that effectively limits access to air-conditioned cells. This approach results in only about 10% of incarcerated individuals receiving scores, despite the vast majority facing significant health risks during extreme heat. The consequences of this policy are dire. Autopsies obtained by the Texas Newsroom reveal that several prisoners who were part of the litigation died under questionable circumstances. These findings underscore the severity of the situation and raise urgent questions about the adequacy of the state's response. The lack of proper cooling systems has led to a dangerous environment where inmates are left vulnerable to heat-related illnesses. As the state faces yet another heatwave, the ongoing legal battle continues. The trial concluded on April 9, but a decision has not been issued. Meanwhile, the TDCJ maintains its stance, insisting that its current measures are sufficient.
