SpaceX has announced it will delay the removal of all unpermitted gas turbines used to power its xAI data centers near Memphis until July 2027. The decision comes as the company continues to operate 69 gas turbines, many of which have been running for months, to support the Colossus data centers. These turbines are located just south of Memphis in Mississippi, close to the Tennessee border. The company is transitioning to a permanent 1.2 gigawatt natural gas power plant, but the current setup remains in place for the foreseeable future. The situation has drawn legal attention, with the NAACP and the Southern Environmental Law Center filing lawsuits against xAI over the use of unpermitted turbines. Federal regulations require permits for such equipment due to their size and operational impact. SpaceX argues that the existing turbines are still considered temporary because they remain on the trailers they were delivered on. However, regulatory authorities disagree, stating that the turbines must comply with permitting requirements regardless of their transport status. SpaceX acquired xAI in February, and in its initial public offering filing, the company outlined plans to invest $2.8 billion in purchasing additional gas turbines for its data center operations over the next three years. The new power plant under development will include 41 gas turbines, varying in size from 16.48 megawatts to 50 megawatts, according to Mississippi state permit documents. While these new turbines appear to differ from the ones currently in operation, TechCrunch noted that specific models of the existing 69 turbines could not be verified. Earlier this year, Elon Musk purchased APR Energy, a firm specializing in temporary natural gas power solutions. Analysis of the company's website prior to its shutdown suggested that its turbine fleet differs from those included in the new power plant permits. Given that APR Energy’s turbines are unlikely to be part of the Colossus facility, the new turbine fleet is believed to be intended for an undisclosed project. The Department of Justice recently supported SpaceX in the NAACP’s lawsuit, asserting that the unpermitted turbines are critical to national, economic, and energy security. This stance highlights the broader tension between rapid technological expansion and environmental regulation. The ongoing litigation underscores the complexity of balancing innovation with compliance in a rapidly evolving industry. Environmental groups continue to raise concerns about the potential pollution from the current turbine operations. The area around the data centers is already among the most polluted regions in the United States, and the existing turbines are projected to emit over 2,000 tons of smog-forming nitrogen oxides annually. As the legal battle unfolds, the long-term implications for both the environment and the regulatory landscape remain uncertain.
