The owner, Tagatoni Limited, applied for planning retention of the 136 square metre awning, but An Coimiúsin Pleanála (ACP) rejected the request. This decision aligns with an earlier refusal by Dublin City Council, which cited concerns over noise disturbance affecting nearby residential areas. The ACP's ruling emphasized the potential impact of the proposed development on the surrounding community. It noted the size, design, and construction method of the awning, along with its proximity to homes, as factors contributing to the decision. The authority determined that the noise generated by the awning during its operational hours could pose an unacceptable nuisance to local residents. Additionally, the ACP found that the applicant had not sufficiently demonstrated that the development would not negatively affect the area’s residential amenity, environmental quality, or established character. Local residents voiced their opposition through three formal observations submitted to the ACP. Eamonn and Catherine Curley, Sheila and Paul Fahey, and Frances Kavanagh, all residing on Marlborough Road, criticized the noise assessment provided by the applicant. They argued that the assessment did not reflect the actual noise disturbances they experienced, which they described as frequent and disruptive. These residents also pointed out that the pub had played loud music in the beer garden at night, significantly altering the use and character of the back garden. Cathal O’Neill + Company architects, representing the applicant, filed an appeal challenging the initial refusal. In their submission, they asserted that any current noise from the premises was part of an established use and that the awning would help reduce sound transmission, thereby improving the acoustic environment for neighboring properties. O’Neill’s team contended that the proposal would enhance rather than detract from the existing situation. This latest refusal comes after a previous denial by Dublin City Council in the preceding year. At that time, Tagatoni Ltd had sought approval to erect a part-retractable awning over the rear garden area to create additional seating space. The council had already raised concerns about noise and the visual impact of such a structure on the neighborhood. The ACP inspector acknowledged the challenge of balancing the interests of local residents with the need for businesses like McCloskey’s to maintain their operations. The inspector noted that while the awning might offer benefits to the pub, the noise assessment provided by the applicant was deemed inadequate and did not address the real-world experiences of nearby residents. The outcome of this appeal will determine whether the pub can retain the awning or must remove it. If the appeal is unsuccessful, the pub may face the prospect of losing a key feature of its outdoor space. The decision could also influence future applications for similar developments in the area, setting a precedent for how such proposals are evaluated.
