President Isaac Herzog has pardoned former Israeli soldier Elor Azaria, erasing his criminal record for the 2016 killing of a disarmed Palestinian attacker, despite opposition from the Israeli military. Azaria, an IDF combat medic, shot dead Abdel Fatah al-Sharif, a Palestinian attacker who had already been wounded by Israeli troops during a confrontation in Hebron. Al-Sharif had stabbed a soldier and lay unconscious on the ground for about 11 minutes before Azaria fired. The incident sparked widespread controversy in Israel and drew international criticism. A cellphone video of the shooting circulated widely, and Azaria was subsequently convicted of manslaughter by a military court in 2017. His initial sentence of 18 months was later reduced to 14 months, and he was released in May 2018 after serving nine months. After completing his sentence, Azaria began serving the remainder of his criminal record in prison in August 2024. However, Herzog announced on Saturday that he had shortened the remaining period, effectively expunging Azaria’s criminal record. The president’s office stated that the decision was based on the passage of time, the completion of his sentence, and the remorse he had expressed. It also noted that the choice was made in the spirit of Yom Kippur and emphasized the importance of reconciliation and moving forward. Defense Minister Israel Katz welcomed the decision, calling it “correct, humane, and worthy.” He praised Azaria’s service as a combat soldier and medic and stressed that the pardon sends a message to soldiers and their families that they are not abandoned. Katz also wished Azaria and his family a “gmar chatima tova,” a traditional blessing for a successful end to the year. Despite the pardon, some military officials opposed the move. Senior army officers, including Chief of Staff Lieutenant-General Eyal Zamir, argued that Azaria had not shown genuine remorse or accepted responsibility for his actions, even a decade after the incident. In a letter to Katz, they noted that Azaria had “refrained from expressing remorse and taking responsibility for his actions, even a decade after his conviction.” The case has remained a point of contention within Israel. While some Israelis supported Azaria, arguing that he acted under duress, others, particularly members of the security establishment, criticized his actions as excessive. The incident also led to international scrutiny, with the Biden administration barring Azaria and his family from entering the United States in 2024 due to concerns over alleged human rights violations. The pardon has drawn mixed reactions. Hardline figures such as National Security Minister Itamar Ben-Gvir have praised the decision, calling it “deeply moving” and urging Herzog to consider similar pardons for political leaders facing legal challenges. Meanwhile, some Palestinians and human rights organizations have expressed disappointment, arguing that the sentence was too lenient and that the case should not be closed. Azaria himself has spoken publicly about the incident. In an interview shortly after his release, he stated that he would take the same actions again, claiming it was necessary given the circumstances. His stance has continued to divide opinions, with supporters seeing his actions as justified and critics condemning them as unjustified violence. As the country prepares for Yom Kippur, the pardon marks a symbolic step toward healing and reconciliation, though its broader implications remain unclear. The decision reflects ongoing tensions between individual accountability and collective memory, as well as the complex interplay between national identity and moral judgment.
