El Tribunal Constitucional debe reconocer la constitucionalidad de la enmienda a la ley de RTV

The Slovenian Constitutional Court is currently reviewing a law amendment related to RTV Slovenia, which changed the management structure of the national broadcaster. Ustavno sodišče je v četrtek, 3. juliju 2026, odločilo, da je novela zakona o RTV Sloveniji skladna z ustavo. To je pomenilo zaključek dlugega in kompleksnega postopka, ki je trajal več kot dve leti. Ustavna pobuda je bila vložena 28. decembra 2022, ko je začela veljati novela zakona, potrjena na referendumu novembra istega leta. Pobudniki, vključevali Petra Gregorčiča, predsednika dotednjega programskega sveta Radiotelevizije Slovenije (RTVS), so se obrnili na ustavno sodišče zaradi skritih napak v novi legislativi. Ključni argumenti so bili, da je novela povzročila predčasno končanje mandatov članom programskega in nadzornega sveta, ter generalnemu direktoru, direktorjem radia in televizije. Tako so predlogi vključevali tudi začasno zadržanje izvajanja novele.

Postopek je bil zelo zapleten. Na začetku leta 2023 je ustavno sodišče začasno zadržalo izvrševanje dveh členov novele, kar je pomenilo omejitve v delu z novim organom RTVS. Nato, 26. maja 2023, je sodišče zadržanje razveljavilo, kar je pomenilo, da je postopek podrobno pregledan in da so sodniki prišli do soglasja. Ključna razloga za to so bila razhajanja med stališči sedmih sodnic in sodnikov, kar je pomenilo, da so bile potrebne dodatne analize. Od takrat je sestava ustavnega sodišča spremenjena, kar je pripeljalo do novih odločitev.

Do 3. julija 2026 je ustavno sodišče finalno odločilo, da je novela zakona skladna z ustavo. Odločitev je bila sprejeta z 5 proti 2 glasovanjem, kar je pomenilo, da so večina sodnikov podpirala novello. Ključni dejavnik v tem procesu je bila podpora za reformo upravljanja RTVS, ki je bila predstavljena kot pot do bolj transparentnega in demokratičnega sistema. Medtem ko so bili nekateri sodniki zaskrbljeni zaradi možnih neposrednih učinkov na institucionalno samostojnost RTVS, drugi so menili, da je novela potrebna za modernizacijo in učinkovito upravljanje.

Ta sprememba je bila pomembna za končno odločitev, ker je omogočila novi pogled na problem.

Odločitev ustavnega sodišča ima širok vpliv na buduče delo RTVS. Ključni elementi novele so vključevali spremembo upravljalnega sistema, kar je pomenilo, da so bili prenovljeni mandati in postopki za izbiro novih organov.
