Woman, alleged boyfriend among three arrested for husband's murder in Telangana's Nizamabad

In a recent legal ruling, the Madhya Pradesh High Court significantly reduced the sentence of a man convicted of murdering his wife, citing the provocative nature of her remarks as a mitigating factor. The case involves Shiva Kahar, a resident of Chhindwara district, who was initially sentenced to life imprisonment for the killing of his 7-month-pregnant wife, Kiran. The court, in a decision dated June 18, reduced his sentence to seven years of rigorous imprisonment, stating that the act was not premeditated but rather a result of a "sudden and grave provocation." The incident occurred on September 18, 2021, when Kahar allegedly assaulted Kiran during an argument. According to the prosecution, Kahar struck Kiran on the head with a stone, leading to her death. In his statement, Kahar recounted that the couple had quarreled on the day of the incident, during which Kiran reportedly remarked, "I will have a thousand husbands like you." This statement, the court noted, was interpreted as an indirect reference to Kahar's perceived worthlessness, suggesting that he lacked value as a human being or a husband. The court considered this remark a significant contributing factor to the provocation that led to the fatal altercation. The trial court had previously convicted Kahar and imposed a life sentence, arguing that the act constituted murder with intent. However, the high court's division bench, comprising Justices Vivek Agarwal and Avanindra Kumar Singh, reviewed the case and determined that the offense did not meet the criteria for premeditated murder. Here, authorities arrested a woman, her alleged boyfriend, and another accomplice for the alleged murder of her husband. The deceased, identified as Ravi, 35, returned to his native village from the Gulf on June 27 and died under suspicious circumstances on June 30. His 60-year-old father, also named Ravi, filed a complaint expressing suspicion over his son's death, prompting a police investigation. During the probe, investigators uncovered that the deceased's wife, Sandhya, 32, was allegedly in a relationship with Anil, 35, a resident of Indrapuri Colony. Police alleged that Sandhya and Anil conspired to kill Ravi and enlisted the help of Venkat Sai, 25, a resident of Nyalkal village. On June 29, Venkat Sai visited Ravi's house, consumed alcohol with him, and, allegedly following Sandhya's instructions over the phone, took Ravi to the terrace of a building and pushed him off. Although Ravi survived the fall, he sustained injuries. The accused then transported him to Nizamabad District Hospital for treatment before taking him to a private hospital and returning him home. Later that night, acting on Anil's instructions, Sandhya allegedly administered an injection mixed with sleeping tablets to render Ravi unconscious. Following this, the accused allegedly threw him from the bed, resulting in his death. All three accused—Sandhya, Anil, and Venkat Sai—have confessed to the crime during the investigation. They were produced before a magistrate and remanded to judicial custody.
