Румен Радев, новият президент на България, е в центъра на все по-напрегнатата политическа и съдебна ситуация в страната. По време на обсъждането и гласуването на поправките в съдебния закон, които трябва да гарантират честния избор на новия Висш съдебен съвет (ВСС), процесът продължи над 7 часа. Това е важно, защото новият ВСС ще бъде отговорен за избора на новия главен прокурор, а очакванията са той да започне голямата битка с олигархията и политическата корупция. Въпреки това, обществото е свидетел на явна колебливост, която се клони към вироглавост, и може да доведе до фатални последици за управлението на "Прогресивна България".
От едно месец по-рано, "Прогресивна България" е ясно демонстрирала нежеланието си да работи с прореформаторските кръгове в опозицията, които ще бъдат необходими за избора на ВСС. Изборът на ВСС е тежко парламентарно усилие, изискващо 160 гласа, които Румен Радев не разполага. В същото време, ПБ показва явно нежелание да съгласува действията си с идеите на "Продължаваме промяната", "Демократична България" и "Възраждане". Това поведение може да доведе до три изхода: парламентарен скандал и блокаж на избора на нов ВСС, скандал и избор на ВСС с помощта на Бойко Борисов и Делян Пеевски, или скандал и избор на ВСС на квотен принцип, договорен с ПП, ДБ и "Възраждане". Във ВСС пак няма да влизат най-достойните, а ще бъдат назначени партийно договорените кандидати.
Тази политическа вироглавост е комбинирана със странна отстъпчивост към съдебното статукво. В сряда вечерта, ПБ се отказа от едно от най-добрите си предложения за промени в съдебния закон – отпадането на скритото повишаване без конкурс на магистрати в по-горна инстанция. Това се случваше чрез назначаването "по изключение" на съдебни и прокурорски шефове от по-долните инстанции. Съдебното статукво се обяви против тази промяна, а "Прогресивна България" се огъна. Предложението бе оттеглено за дообмисляне. Въпросът е: какво има толкова да му се мисли? Ако ПБ се колебае по този въпрос, какво остава за другите, далеч по-тежки въпроси?
Българската съдебна система от години страда от няколко базови проблема – твърде много съдилища, които обслужват намаляващо население. За тези съдилища трябва да се търсят ръководители и администрация, което само увеличава разходите. Сегашният ВСС обаче твърдо отказа да закрие съдилища в малките населени места. Вторият проблем е свързан с порочното кадруване. Последните три състава на ВСС корумпираха напълно кадровите процедури в съдебната власт до степен, в която нормалните магистрати просто отказаха да се кандидатират за ръководни позиции. Ако новият ВСС реши да продължи реформата на съдебната карта и намали броя на съдилищата, като едновременно с това реформира и кадровата си практика, проблемът с липсата на желаещи за шефове ще се реши от само себе си. В "Прогресивна България" би трябвало да има хора, които знаят за тези неща, защото те се случваха пред очите на цялото общество в продължение на десетилетия.
По-големият проблем е колебливостта. Политическо-криминалната омерта, овъртолила големи части от съдебната система и политическите кръгове, ще използва всяка възможност. ГЕРБ обеща на "Прогресивна България" пълна подкрепа за избора на бъдещия Висш съдебен съвет, без да има "никакви кадрови претенции" към партията на Румен Радев. Това става ясно от интервю на депутата от ГЕРБ Владислав Горанов пред Mediapool. Подобен политически празен чек развързва ръцете на ПБ, която няма да има нужда да съгласува реформата в съдебната власт с "Продължаваме промяната", "Демократична България" и "Възраждане". Заявката за подкрепа на Борисов към Радев има за цел единствено да елиминира по-радикалните настоявания за реформа от страна на ПП и ДБ, които не са в полза на ГЕРБ и влиянието на партията в съдебната система. "За Висшия съдебен съвет темпото за избор на нов (съвет) зависи от мнозинството, ние сме готови да подкрепим без никакви претенции кадровите решения на Румен Радев за състава на ВСС", казва Горанов. Ходът на Борисов дава възможност на Румен Радев да продължи досегашната си умерена линия на поведение към съдебната система. Новият български премиер вече учуди мнозина с избора на Николай Найденов за правосъден министър, въпреки че кариерата му е свързвана с бившия главен прокурор Сотир Цацаров.
