Alexander Leo: If something is not in their mind, the prosecution is politicized

A dispute has emerged around the case of the "two towers," with Aleksandra Leo asserting that if something does not align with their views, then the prosecution is politicized. During an interview on TVN24's "Kropka nad i" program, Leo commented on the reactions of PiS politicians regarding the discontinuation of the investigation into the "two towers." She stated that if something suits them, the prosecution is good, but if it doesn't, then it is politicized. The current Public Prosecutor’s Office in Warsaw discontinued the investigation into the "two towers" due to the absence of evidence of prohibited actions. This case came to light in 2019 and involves unfulfilled plans to build two skyscrapers on land owned by a company linked to PiS, Srebrna. An Austrian businessman, Gerald Birgfellner, claims that Jarosław Kaczyński deceived him during the preparation of this investment.

Leo was asked whether she believed the decision by the prosecution was an attack on the image of the Civic Coalition. She firmly denied this, stating that PiS politicians comment on the prosecution selectively. According to her, if something aligns with their interests, the prosecution is good, but when it comes to matters such as the discontinuation of the investigation concerning Mr. Wąsik and Kamiński, the prosecution is politicized. She considered this approach absurd and noted that the prosecution had been politicized during the time when Zbigniew Ziobro was the Minister of Justice.

Kazimierz Smoliński, another guest on the program, commented on the decision by the prosecution. He pointed out that in relation to other investigations, this situation is somewhat different because the process had already been discontinued once before. There was an appeal, the court annulled the discontinuation, issued guidelines, and after analyzing these charges from the court, the prosecution concluded there were no grounds to suspend the proceedings. When asked whether the decision to discontinue the proceedings indicates that the current prosecution is not politicized and can handle all cases, Smoliński responded that both previous and current prosecutions reached the same result—discontinuation. Therefore, he argued that the former prosecution acted correctly, and so did the current one, proving that the former prosecution proceeded appropriately.

In a conversation with Professor Andrzej Nowak, Nawrocki spoke about a "moment of crisis" during his presidential campaign. Following these reports, the prosecution initiated an inquiry. Commenting on this matter, Aleksandra Leo noted that neither Nawrocki nor his entourage called an ambulance. If his health or life was genuinely threatened, they should have done so. She emphasized that the services, police, and authorities should have been informed if there was a genuine suspicion that the candidate had been poisoned.

Leo also pointed out that the issue surfaced only a year after the incident. She suggested that this delay might be aimed at promoting a new book about the behind-the-scenes aspects of Nawrocki's campaign or to cover up scandals associated with the president, such as the three vetoes related to the cryptocurrency market law. She claimed that the story does not hold together and added that the president had placed some of his collaborators in difficult situations. Failing to call an ambulance when someone's life is in danger and they witness it is already subject to Article 162 of the Penal Code.
