Tragická nehoda na visuté lanovce v Liberci v říjnu 2021, která zabila průvodče, vyvolala závažné právní postupy. Tři fyzické osoby i právnická osoba – České dráhy – byly obžalovány za přečin obecného ohrožení z nedbalosti. Náměstek okresního státního zástupkyně Kamil Látr informoval, že obžaloba byla podána 30. června k Okresnímu soudu v Liberci. Obžalovaným hrozí až deset let vězení.
Podle závěrečné zprávy Drážní inspekce byla hlavní příčinou nehody chybějící prvky zajišťující automatickou aktivaci brzdy. Lanová dráha byla provozována bez těchto prvků, což bylo v rozporu s právními předpisy, normami a technickou dokumentací. V minulosti byly tyto prvky neoprávněně odstraněny. Průvodčí v kabině, ve které byl sám, nebyl schopen ručně aktivovat vozovou brzdu kvůli sílám, které na kabinu působily. Na štěstí, třinácti cestujícím v druhé kabině se nestalo nic díky tomu, že jejich průvodčí manuálně aktivoval záchrannou brzdu, což zastavilo kabinu, která rychle sjížděla zpět k dolní stanici. Kabina zůstala viset 15 metrů nad zemí, a cestující museli být vyproštěni hasiči.
České dráhy, které lanovku vlastnily, sdělily, že podání obžaloby vzaly na vědomí a s obsahem se nyní seznamují. Mluvčí firmy Vanda Rajnochová zdůraznila, že firma nadále tvrdí, že za tragickou událost nenesou trestní odpovědnost. Přitom upozorňuje, že vzhledem k probíhajícímu trestnímu řízení si nebudou dále komentovat případ. Tato pozice je konzistentní s předchozími prohlášeními, když firmu opakovaně informovalo, že s obviněním nesouhlasí a je připravena se proti němu bránit.
Lanovka, která byla mimo provoz po nehodě, byla odkoupena městem Liberec. Město plánuje výstavbu nové lanové dráhy s jiným systémem a prodlouženou trasou ke konečné tramvaji v Horním Hanychově. Nová lanovka by měla být v provozu za čtyři roky. Tento projekt je v souladu s pokyny, které vyplývají z incidentu, a má poskytnout bezpečnější a efektivnější dopravní možnosti pro obyvatelstvo regionu.
Z pohledu právního řízení se situace ukazuje jako složitá. Státní zástupce podali obžalobu na tři fyzické osoby a právnickou osobu, ale České dráhy zůstávají v pozici obžalované strany, která tvrdí, že nemá trestní odpovědnost. I když existují různé názory na rozdělení odpovědnosti mezi individuální osoby a organizaci, fakt, že průvodčí nebyl schopen aktivovat brzdu, naznačuje, že systém byl nekompletní a nebezpečný.
