On Friday, July 30, 2026, Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan reaffirmed this stay, citing the unresolved nature of the case and the pending submissions from both the ECI and the Tamil Nadu Legislative Assembly Secretary. The court’s decision came after a writ petition filed by K. Venkatachalapathy, a resident of Tirunelveli, through his legal representative V.R. Shanmuganathan. The petitioner argued that the by-elections were necessary due to the resignations of elected members in these constituencies. However, he also raised concerns that holding the elections while individual election petitions against the current sitting MLA candidates were under consideration could result in a scenario where each constituency might have two representatives simultaneously, namely, the incumbent MLA and the candidate declared as the winner of the petition.
