Britain's Reform UK party has proposed deploying the navy to intercept and return asylum seekers arriving by boat, a plan critics argue is both legally dubious and diplomatically risky. The initiative, called “Operation Fortress,” has sparked controversy, particularly with France, which has strongly opposed the move. Reform UK leader Nigel Farage, facing mounting political pressure due to financial scandals and an upcoming by-election, defended the plan as a necessary step to safeguard national security. He framed the operation as a “rescue and return” effort, emphasizing its humanitarian intent and asserting that it would comply with international law. According to Farage, the plan aims to prevent what he describes as an “invasion” of migrants arriving in Spain’s North African enclave of Ceuta, mirroring similar patterns in the English Channel. He pledged that, should Reform UK win the election, the country would launch the largest military operation in the region since World War II to ensure individuals are “immediately returned to their point of departure.” France has responded with firm opposition, dismissing the plan as a threat to sovereignty and regional stability. Reform UK’s spokesperson, Zia Yusuf, accused France of sending “200,000 illegal migrants, including murderers and terrorists,” and claimed that marines would return them to French shores regardless of objections. However, experts warn that the proposal lacks legal and practical viability. International maritime law does not permit one nation’s armed forces to enter another’s territorial waters to seize and return individuals, according to the Centre for Military Justice. Such actions could constitute a serious violation of international agreements. Mihnea Cuibus, a senior researcher at the University of Oxford’s Migration Observatory, noted that unilateral action by the UK could prompt France to halt cooperation, including intelligence sharing and joint border patrols. Implementing the plan would likely require a bilateral agreement, which France is unlikely to accept. Legal scholars and refugee rights advocates have also criticized the plan as a violation of both UK and European law. Sarah Singer, a professor of refugee law at the University of London, described the proposal as a “complete waste of military resources.” She pointed out that summary expulsions contradict legal requirements for individual case assessments before removals. The same strategy was previously considered under the Conservative government led by Boris Johnson in 2022, but it was abandoned due to concerns over its legality and safety. Former Home Secretary Priti Patel had once supported a similar approach, claiming it would make Channel crossings “unviable.” However, military officials raised concerns about the risks involved, leading to the plan’s abandonment. Former Navy Commander Tom Sharpe has echoed these concerns, calling the proposal “sketchy in theory, dangerous in practice.” He warned that while the Royal Navy might technically enter French waters without permission, doing so would expose the UK to legal challenges and escalate tensions in the region.
