Po skoraj štirih letih od izbruha skandala Fotopub se je Dušan Smodej v ponedeljek končno pojavil pred sodiščem, kar je pomenilo začetek njegovega sojenja.
To je pomenil pomemben trenutek, saj je bil primer v preiskavi od avgusta 2022, ko so na spletu začele krožiti anonimne obtožbe o domnevnem nepravilnem ravnanju mladoletnikov in drugih oblikah izkoriščanja v klubu Fotopub, ki ga je nekoč vodil Smodej.
Sodna obravnava je potekala zasebno, potem ko je tožilstvo zahtevalo izključitev javnosti, da bi zaščitili osebno življenje žrtev. Ena od žrtev je bila v času domnevnih incidentov mladoletna.
Smodej je takoj po izbruhu škandala zanikal vse obtožbe in trdil, da je bil žrtev izsiljevanja. Vendar pa je število in doslednost prič, zlasti glede narave domnevnih praks, povzročila resne dvome. Škandal se je hitro razširil po socialnih medijih in sprožil razprave tako v glavnih medijih kot v političnih krogih.
Policija je začela obsežno preiskavo po izbruhu škandala, izvedla je več kot 80 intervjujev s pričami in pregledala več kot 5000 spletnih objav. Smodeju so vložili več kazenskih obtožb, vključno z sumom kršitve spolne integritete, omogočanja uporabe prepovedanih drog in povzročanja hude telesne poškodbe.
Spomin na "Fotopub" je sprožil polemiko v levičarskih političnih krogih v Sloveniji, zlasti med člani koalicijske stranke Levica. Sprva je Luka Mesec, koordinator stranke, trdil, da ni imel povezave s Smodejem in se nikoli ni udeležil nobenih dogodkov na Fotopubu.
Te povezave so večkrat povzročile nemir med Vrečkom in Mesecom, ko se je afera Fotopub omenila v javnih razpravah.
Skandal Fotopub je izbruhnil avgusta 2022, ko so se na družabnih omrežjih pojavile anonimne trditve o dejavnostih okoli kluba, ki ga je vodil Smodej. Po škandalu, ki je pretresel slovenska kulturna in širša javna področja, je Smodej razpustil klub in nadaljeval umetniško kariero v tujini, predvsem v Italiji in Franciji.
Sodišče je prav tako zahtevalo povračilo potnih stroškov, če bi moral priti v Slovenijo. Na dan obravnave Smodej ni razkril svoje trenutne lokacije, vendar je navedel, da je vizum dobil od Ministrstva za zunanje zadeve prek veleposlaništva.
