A man has received a minimum 17-year prison sentence for murdering a homeowner during a botched drug-related break-in in western New South Wales. Mark Peckham, 34, was found guilty of killing George Kirk, 41, in August 2023 and was sentenced on Monday by Justice Nicholas Chen at the Supreme Court in Orange. The judge imposed a total of 24 years in custody with a non-parole period of 17 years and six months. The sentence marks the culmination of a trial that concluded earlier this year following a jury’s finding of guilt. The incident occurred on August 16, 2023, when Peckham and an unnamed accomplice entered the home on Margaret Crescent in the early hours of the morning. They approached George Kirk and his partner, Tammy Antaw, demanding access to drugs. When both denied having any drugs in the residence, a confrontation erupted. During the struggle, Kirk was stabbed multiple times. According to testimony given by Tammy Antaw, Peckham delivered the fatal blow, striking Kirk beneath the left armpit and piercing his lung. Another resident present at the home called emergency services, but Kirk could not be revived. Tammy Antaw described witnessing Peckham stab Kirk twice, after which Kirk reportedly asked, “What are you trying to do? Are you trying to kill me?” The court relied heavily on her account, along with statements from other witnesses, to determine that Peckham was responsible for the fatal injury. This evidence was critical in establishing his culpability, despite the presence of a second suspect. George Kirk’s family attended the sentencing hearing and submitted written statements expressing their anguish. His parents stated they loved him deeply and missed him every moment of every day. They described how their lives had fundamentally changed since his death, noting a loss of safety and confidence. His sister, who is nine years older than him, spoke of feeling like a mother to her younger brother and expressed deep sorrow, stating she was “broken” and that her heart was “torn in two.” She described the grief and trauma as unbearable. The court considered several aggravating factors, including the fact that the crime was committed inside a private home, a place where residents should feel secure. The presence of two men entering uninvited in the dead of night was deemed particularly menacing. Additionally, Peckham was on bail at the time of the offense, and the court noted his extensive criminal record, which includes 10 years of incarceration in New South Wales and Queensland since 2009. Peckham’s defense lawyer, James Trevallion, argued that his client required psychological intervention rather than harsher punishment. He highlighted Peckham’s documented mental health issues, including a diagnosis of post-traumatic stress disorder stemming from childhood trauma. However, Justice Chen did not find Peckham remorseful and pointed to his history of drug use and repeated offenses as factors influencing the severity of the sentence.
