She pointed out that the charge does not apply because “there was a single act, a single shot, a single bullet, a single victim.” She argued that the case lacks multiple shots or threats, which would qualify under the state’s aggravated murder statute. Judge Graf acknowledged the aggravating factor in his ruling but noted that the state has met its burden of proof in this preliminary stage. However, he did not rule on the merits of the case itself. The judge allowed both sides to present their final arguments before reaching this decision.
