Indonesia has introduced a new regulation that allows certain mining exporters to retain up to 30 percent of their natural-resource export proceeds for three months instead of the current requirement to hold 100 percent for 12 months. The change, outlined in Article 18A of Government Regulation No. 21/2026, aims to improve macroeconomic stability, support downstream development, and encourage investment. This adjustment marks a shift in how the government manages export proceeds for the mining sector. The revised rule was based on analysis of export customs declarations submitted to the Directorate General of Customs and Excise from March 2025 through July 2026. During this period, 537 tax identification numbers were identified as belonging to mining exporters. After cross-referencing these records with the Directorate General of General Legal Administration, 64 tax IDs, approximately 12 percent, were found to meet the eligibility criteria for the new facility. These companies are primarily limited liability entities with shareholders from designated partner countries. The designated partner countries include the United States, China, Hong Kong, Australia, and Canada. According to Susiwijono Moegiarso, secretary of the Coordinating Ministry for Economic Affairs, these nations account for the majority of foreign investment in Indonesia's mining industry and have existing trade agreements or understandings with the country. The policy is intended to align with international standards and enhance transparency in the sector. Under the new provisions, eligible exporters can keep up to 30 percent of their export proceeds in foreign-exchange banks for a period of three months. This flexibility is available only to companies that qualify under the specified conditions. The government has approved 15 banks for managing these special accounts, including five state-owned institutions and 10 private-sector banks. These banks will handle the placement of funds according to the terms of the facility. The special facility will become effective on September 1, 2026. Exporters who wish to opt out of the program must submit a formal declaration to Bank Indonesia within five working days following the release of the eligible exporter list. Those who fail to provide such a statement will be presumed to have accepted the new arrangement. Companies that choose not to participate will continue to follow the standard rules set forth in Government Regulation No. 2/2026. For non-oil-and-gas mining exporters, the general rule requires them to hold 100 percent of their export proceeds for 12 months. Oil-and-gas exporters, however, are already allowed to retain at least 30 percent for three months. The new facility provides additional flexibility for all qualifying companies, particularly those operating in the broader mining sector. This regulatory change reflects ongoing efforts by the Indonesian government to streamline processes and attract more investment into its natural resources sector. By offering greater flexibility in fund management, the policy seeks to balance economic growth with fiscal responsibility. It also underscores the government's commitment to improving transparency and efficiency in the mining industry.
