The Federal Communications Commission (FCC) voted on Wednesday to prohibit the sale of devices in the United States that include key hardware components from Chinese firms identified as national security threats. This decision marks a significant escalation in efforts to restrict the influence of Chinese technology within the U.S. market. The move specifically targets components manufactured by entities such as Huawei and ZTE, both of which have been flagged for their potential role in compromising cybersecurity. The rule change aims to eliminate a previously existing loophole that allowed devices incorporating components from restricted Chinese firms to still receive authorization for entry into the U.S. market. Since 2022, new devices produced by these firms have been barred from obtaining new authorizations, but devices containing their component parts could still gain approval. The new regulation now prohibits the sale of any device containing Huawei-made logic-bearing hardware components, thereby closing this gap. FCC Chair Brendan Carr emphasized that the agency will “fully close the component part loophole,” ensuring that no device with potentially compromised parts can enter the U.S. market. This action aligns with broader measures taken by the U.S. government to limit the presence of Chinese technology infrastructure. Last month, the FCC expanded its restrictions by banning the import of additional equipment from a group of Chinese manufacturers, effective July 16. On Tuesday, the commission also proposed a ban on the import of most military-grade drones, further tightening controls on foreign technology. In addition to these actions, the FCC has already prohibited the import of new foreign drone and router models in recent months. It has also proposed to prevent U.S. telecommunications carriers from interconnecting with Chinese telecom firms considered a threat to national security. These steps reflect a growing concern over the potential vulnerabilities posed by foreign technology in critical infrastructure sectors. The administration under former President Donald Trump initiated a comprehensive campaign against Chinese technology, leading to increased scrutiny of products and services originating from China. This trend has continued under the current administration, with ongoing efforts to reinforce regulatory barriers against perceived security risks. Chris McGuire, a former White House National Security Council official during the Biden presidency, warned that compromised components, especially semiconductors or communication devices, can be exploited to undermine entire systems. The FCC’s latest ruling adds another layer to the complex web of regulations governing the flow of technology goods into the U.S. market. It also raises questions about how Chinese telecom companies operate within the country, particularly those that manage data centers or Points of Presence, which are crucial nodes in internet exchanges. The commission is reportedly considering banning these companies from interconnecting with other service providers, which would force them to cease operations in certain U.S. locations. These developments underscore the increasing focus on national security in shaping technological policy.
