Families of victims in Hong Kong's 2012 Lamma ferry disaster have abandoned their judicial review petition following the denial of legal aid, ending a protracted legal struggle. The decision came after High Court Judge Herbert Au-yeung Ho-wing confirmed on Wednesday that the case has concluded, as the plaintiffs informed the court two days prior they would no longer pursue the challenge. The four families, comprising Alice Leung Shuk-ling, Leung Ka-yan, Philip Chiu Ping-chuen, and Tsui Keung, had initiated the legal action in April, responding to the verdict delivered by the Coroner’s Court in March regarding the deaths of 39 individuals during the incident. The Lamma IV, a vessel transporting 124 Hong Kong Electric workers and their family members to witness the National Day fireworks display over Victoria Harbour, met its fate when it collided with the catamaran Sea Smooth off Lamma Island. This collision led to the ship sinking, marking one of the deadliest maritime accidents in Hong Kong in recent decades. The tragedy occurred on October 1, 2012, and left a profound impact on the community, prompting ongoing investigations into the causes and responsibilities surrounding the disaster. The plaintiffs' attempt to challenge the coroner’s findings was based on several key points, including allegations of gross negligence by the ship’s coxswains. Coroner Monica Chow Wai-choo issued her ruling in March, determining that the fatalities were unlawful, citing the coxswains' actions as a contributing factor. According to Chow, this omission was intentional and aligned with regulatory standards at the time the vessel was constructed between 1994 and 1995. Despite these findings, the families faced obstacles in continuing their legal fight. Their application for legal aid was rejected, leaving them unable to afford the necessary representation to contest the coroner’s conclusions. Without financial support, the families opted to withdraw their judicial review, effectively concluding their efforts to seek further accountability or clarification regarding the circumstances of the disaster.
