The Mexican federal judge Daniel Marcelino Niño Jiménez rejected a legal challenge filed by Ramón Ángel Álvarez Ayala, known as "El R1," who was accused of being the intellectual author of the murder of former mayor Carlos Manzo. The request, which sought to block his potential extradition to the United States, was dismissed as improper because the actions it aimed to prevent were hypothetical rather than actual. Álvarez Ayala, a lieutenant of the Jalisco New Generation Cartel (CJNG), was detained by federal forces in July in the municipality of Atotonilco, Jalisco, during a law enforcement operation. He had been identified as a key collaborator and trusted associate of the late drug lord Nemesio Oseguera Cervantes, known as "El Mencho." Under Oseguera’s command, Álvarez Ayala was responsible for overseeing narcotics trafficking operations in the metropolitan area of Guadalajara and northern Jalisco. Following his arrest, Álvarez Ayala submitted a petition seeking judicial protection against any future orders of extradition, expulsion, or deportation issued by the Ministry of Foreign Relations. This move came after he was charged in a U.S. court with drug trafficking offenses. A jury in the District of Columbia Court convicted him and his brother, Rafael Álvarez Ayala, known as "El R2," of smuggling cocaine and methamphetamine into the United States. In his ruling, Judge Niño Jiménez stated that the claim for judicial review did not apply to future acts that have not yet occurred. According to the judge, for an amparo petition to be valid, the action being challenged must already exist at the time of the filing. Only then can there be a tangible impact on the individual's legal rights, making the remedy necessary. Since the alleged actions, extradition or expulsion, are speculative, they do not meet the criteria for a proper amparo case. The decision underscores the legal principle that individuals cannot seek redress for potential future actions unless those actions are already in motion. In this instance, the judge concluded that Álvarez Ayala’s request lacked the necessary foundation to warrant intervention. His current detention is under high-security conditions at the Altiplano prison facility.
